hi brother's i wish everything is good with you all afterward my wife want to send rebuttal to the USCIS to make them change them desecion about denied my visa because you all know they dont have the last desecion yet so pleas help us to know what my wife have to send to help us for our case .because my wife she was crying all the night yesterday and it killing me to see her crying.thank you for you all my friend's

Your wife should be asking the questions here. You dont give any of the information required to allow people to provide advise. What has happened in your case is not unusual for cases from your country. You were given a form that had the reason for the denial. It also told you the case would be sent back to USCIS in the USA.

You indicate you dont believe USCIS has the final decision. They certianly do. One of their officers made the decision to deny your visa.

Please have your wife post the questions here so that you may monitor the info. This will provide some true understanding of the situation by both of you.

That's a good decision, on your part - always listen to you wife.

But to answer your question..

She will not have any chance to provide a rebuttal unless and until USCIS office asks her for it. There's some things that happen prior to that, and indeed, she may not be asked to provide a rebuttal, at all.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Many of the people on this site are extremely knowledgeable, and having completely gone through the immigration process many of them know what they are talking about, some even more than some lawyers ive heard about!

You are wise to never trust people online, however when there are multiple people re-affirming the same fact, it generally means its true. If you have done your research, and your wife has done research you shall find the answers you seek. It may be alot more time consuming than coming here and listening to the experts, but you will find them eventually.

I personally could not have done the immigration process without the help of people from this site and from similar forums, their wise advice helped me shave off about 2 months time and Know exactly what i had to send in when etc. So if you do not wish to return, fair play.... however These sites contain hoardes of good info :)

I wish you luck with your VISA.

Also though one quick word. I understand she may not trust people but one of the best ways to learn is from people who have been through the same experience. Think about drug addicts.... a person who has never done drugs cant really give them many words of wisdom on how to quit, but a former drug addict can because he knows what its like and he knows the steps. Its the same kinda scenario here.... There are officials who can give you the 'official' advice, but the best advice comes straight from the people who have taken the same journey and who understand the steps, so trust them or not, its worth reading :)

Now I will leave your thread, just wanted to add that in :) good luck once again, I hope you are with your wife soon. I know how hard it is being away from your loved ones.

In that case I suggest that your wife consult an experienced, qualified immigration attorney where she can discuss all the specifics of your case. That will help her to get advice that deals directly with any issues that pertain to your situation. It will be money well spent.

Souufiane,

Look at the possible 'red-flags' with your case. I am not saying you have these, but these are the normal ones the consulate sees in Casablanca:

These might be:

-If your wife is older than you

-If you married the first time you met in person

-If she stayed only a short time in Morocco

-If you expressed love for her within the first few weeks or months of meeting her online and this was revealed to the Consulate

via chat logs or something

-If you proposed marriage to her soon after meeting her online

-Getting married within the first year of meeting online

If they see any of these factors, they will put a 'fraud' slip on your case and do an investigation to see if your case is fraud.

If they aren't sure, but suspect, they will ask you questions at the interview to confirm their suspicions or they may have already

decided when they interview you that they think it is fraud. In this case, you need to prove them otherwise. That is what you

need to do now.

Man, this gets annoying. You used already 3 different names asking the same question over and over again. Seriously, you trashed entire discussion forum area. Get an attorney. If your wife does not believe people on this forum she will not follow advice that you will provide to her through this forum. So, stop it. There is a summary: 1) YOU GOT YOUR VISA DENIED. 2) YOU HAVE TO WAIT FOR THE USCIS TO CONTACT YOU. 3) ONCE THIS IS DONE YOU CAN RE-BATTLE. Give it a rest. MY ONLY ADDITIONAL RECOMMENDATION IS FOR YOUR WIFE TO MOVE TO MOROCCO. PERSONALLY, I DO NOT SEE A SINGLE POSSIBILITY FOR FINAL APPROVAL WITHOUT HER MOVING TO MOROCCO. THEY MAY RE-AFFIRM THE CASE BUT WILL STILL DENY IT IF SHE DOESN'T. END OF CONVERSATION.
