hi everybody i went to doctore today becaus i could not eat like 2 day ago and that because they refusing my CR1 VISA i have some question and i wish to found the answers pelas

1 is the fomre show that they refusing the visa or just they want more information

2 if my wife call the senator do you all think that will help us

3 do you think it good to cancel the application and have a new one or leave it like that till the uscis got my application and see what will happend

4if my wife will send letter to uscis every week that will help or nop

i wish you all help me pleas pleas pleas

First you need to calm down, let the anger go because as you see it's making you sick !

1- You did not get denied, they are sending the petition to USCIS to make the next decision. A visa is not allowed right now.

2-Your wife should have her Senator/Congressman make inquiries in the case. It may help and may not but nothing to loose if trying.

3-Do not cancel the petition, you filed as married so they will have to review it eventually.

4-Sending letters every week is probably going to get on their nerves and could slow down the review.

Again- You need to CALM DOWN :bonk:you will make yourself more sick. You haven't lost your wife!

Nobody knows the reason here.

From what you told us here:

She's older then you.

She has a daughter who does not talk to you.

You did not know anything about her diploma.

You met online from a social website.

You probably had some communication problems with the Consular Officer.

I'm sure there are some more red flags that you did not mention yet.

Has your wife come to this website? Perhaps she can gain some knowledge here.

but her daughter she have 18 year and she is not a baby she is always with her boyfriend how i can talke with her and when she come to the house she drink medecine because she is sick and she go to sleep so that really stupid if they think i can know everything about her daughter

so do you think they will accept my visa soon or nope

Some day soon, the entire casefile will be sent back to usa and maybe the USCitizen will be given an opportunity to appeal the DoS Decision through some USCIS office.

It's going to take about a year for them to review it. They might ask your wife to send in more information at that time. If they reaffirm it, you will get another interview. If you don't pass that interview, you're pretty much done.

Don't start a new petition- it's a waste of money, will take just as long as a review, and if you haven't fixed the issue that got you denied in the first place, you will be denied again.

This is going to take some time. It will take at least 45 days for USCIS to even get the petition back from Casablanca. There is no way to make it faster. Best idea now is to calm down, have your wife come visit you, and work on a defense for when your petition is reviewed.

By the way, you've been told this several times by various people. I know it sucks, but you have to think clearly through this and be patient. Good luck.

# 1 The form clearly say it has been sent back to USCIS in the USA. At the bottom the form says the USC could contact the USCIS office in their area for info.

What this means is for the USC to make an INFO PASS appointment to go see USCIS to discuss the situation. That is best way to understand what happened & what may be done. That should be done within about 4 weeks. She could try the phone but its better to go in person if possible.

#2 Your wife can not call the Senator. She must use the Senators web site to make out a form to request help. The Senator has a staff member trained to placte the citizens.

#3 A new application wont result in a different outcome. It isnt the paper work that is in error. It is the nature & quality of your relationship.

#4 Letters sent will simply end up in the trash.

#5 Your wife as the USC should be on this site. Posting, reading, replying to get first hand info that is clearly understood. You should read & discuss with her. I mean that with all respect to you. I know you are trying but this is deadly serious.

OUr visa petition was sent back to USCIS for review too. I am the american, so I called my senator, have your wife call the senator's local office in her town, not the office in Washington DC. THey will most likely ask her to do 2 things - fax a letter to their office describing your request - to have the senior consular officer review your file, to be told the reason for the denial as well. They will ask her to fill out a privacy release form. This will be found on the senator's website. she can do a search on his name to find his website. I went to fedex to fax my forms in.

My fiance and i also wrote several USCIS offices, Embassy again, etc. Our emails were about 5 pages long and detailed our relationship. How we met, and how I have dated INdians before and how alot of Indians attend my church, etc. I got a call from the senator's office about a week later. The embassy amazingly agreed to give us a 2nd interview. THis is extremely rare, but I think it was my 5 page letter which did it. I quoted visa statistics and used examples of couples who were also denied at Delhi embassy. this happens alot at Delhi.

I hate to say it, but more than likely they will still deny your petition, but should give you a definite reason for the denial.

Also, you can use form G-639 - have your american wife fill this form out and request a copy of your file and ask specifically for the consular notes.

I'd suggest seeing a lawyer too. Give them all the copies of everything you turned in and see if they can find what went wrong.

THe petition is valid for 1 year, per that letter you posted, so I would not refile yet. I would wait for the process to continue.

thank you for all your answers and yess my wife she call the senator's and he told her to go to the site and download a form and she did that and sent it by fax and she sent the form show they are refusing my visa and the form show my interview because they ask about that too so do you think becaus i have CR1 visa they will not cancel my application but they will review it and make a desicion to give me the visa or other interview if that right pleas answer me thank you
