fiance left before we.re done

need some help here my fiance and I had a few problems when she came here and after 6 months and some problems she needed to help out at home with she went homement

after we were married here within the 90 days but we never got the adjustment papers in.Now she's been gone almost 16 months and we are trying to work things out

.How after all the changes with k1 etc ,how do i start the process to get here back here? Any help I thank you in advance Chris

At this point I am pretty sure you would have to file another petition for her to enter the country again...

thank and so sorry I forgot to add she has a daughter that is an american citizen born in thailand to american and she has a american passport could she follow her under that angle?

Are you asking if the mother could follow the daughter?? I think no...

It may be possible for the Daughter to petition for her mother... how old is her daughter, and is she here in the states now??

well the daughter is only 5 yrs old and went back with mum in feb last year. But i am thinking could some how have her come with daughter to the u.s

only I am thinking because the daughter is not mine,they might ask why is the daughter of 5 yrs old coming to us. we had a fiance visa going when she came here 2 years ago.

K1 is a single entry visa, since it was used and your wife did not adjust status. You will have to file the I-130 for a spousal visa (IR-1/CR-1).

September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!

September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file

thank you yes she is my wife we were married after she got here in 2009 .Only am worried about the boniafied stuff about marriage, it took about 15 months to get her here on the fiance visa and she was only here 7 months than went back home.I was in the process of selling my house so she has no record of living with me as far as joint accounts to little time here.And we were having a few problems so I didnt add her to checking or credit cards until we were to work out.i do have her on insurance and life insurance but thats it.Now she's back in thailand so only phone and email records to date.I will look at the cr1/1r1 visas.Thinking might be better of divorcing her and starting the fiance part all over less documents?thanks agian chris

File the I-130 for an CR-1/IR-1 visa.

No need to file additional petition on the daughter, she has USA passport already, can come and go at will.

No no no. That would be actually MORE documents. Do not complicate things when you can just simply file I-130 for spouse visa.

I suggest you NOT take this approach, at all.

While you think is less documents NOW, it will be more documents after she's in the USA, to file the Adjustment of Status.

Plus you have to materially substantiate WHY you divorced her, and wish to file another I-129F petition after divorcing from her.

IMO, your temporary estrangement can be covered in a cover letter submitted with the I-130.

Thank you thats a great point! and thank you everybody for the help I will move ahead with the I-130 and include the cover letter,Our process through

embassy in thailand went really smooth for the k-1 only hang up we had was the father of child wasn't helping us signing off on american passport even

though he had nothing to do with her,And a nice woman at the embassy helped us press him .thanks agian chris
