She will have to tell the CBP officer at POE wht her purpose of entry is and why she is coming to US and there is no guranteed entry to US on tourist visa.

It would be much advisable for you to visit her home country get married there and then based on your LPR status you file immigration papers for your wife.

I don't think you can petition her unless you are a USC

Sorry, can't help you with Fraud. You joined today and asked us how can I pull this off?

You Can't. Are you a USC. That matters. You stated "Fiancee'" So the intention is to get her here on a Tourist Visa.

Find a new way. It will never work.

Thanks for your reponse

I am a green card Holder, and am not yet get maried with her, just i know her since a time

so, she will asking for a visa tourist to came visit his friend, and whene she came i want to make with her a mariage here in the city hall like i meet her first time here in USA .

I know it should be i get Citizen to bring my wife her, but am looking for a short way

just whene she came her, we will make a mariage at city hall after few days whene she came or in the last days of her visa

so no one can say she came here to make mariage or it's a visa fraude becaus it's no proof for that

So i think it gonna be not a visa fraude because i dont have any things official with her in his country home.

so It's gonna be right way or not

thank you again

What you are talking about IS fraud because you have already admitted that you will both lie and claim that you have just met when you haven't.

Why not do things the right way and wait till you are a USC and then petition her as K1 or marry her and file for CR1.

We all want our loved ones here quicker too, but everyone here is trying to do it right and are willing to wait.

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

Thank you, VJ! smile.png

I can appreciate that you want your loved one here sooner rather than later.

It appears that you are asking for a way to shorten your waiting time but it is not clear whether you are also asking about a way to shorten it by bypassing part of the immigration process. Perhaps you can make your intentions more clear for us?

Are you asking if it is alright for your loved one to get a tourist visa to come to the US, get married while she is here, and then return home at the end of her visa so you can start the proper immigration process? Or, are you suggesting that your loved one comes to the US on a tourist visa, gets married and then tries to stay here in the US while waiting for her immigration status to be legalized?

Your loved one may succeed in getting a visitor's visa to the US but she should make sure that she doesn't lie to the US official. She must answer all questions truthfully or she can later be found guilty of lying to immigration authorities. Is she really visiting your friend as well? If so, then it is alright to say so, otherwise she should give the true reason for her visa request - to visit you. She is allowed to get married in the US - she is just not allowed to stay in the US until she has the proper permission from the US government. So, even if she does come on a visitor's visa and you get married, she needs to leave before her visa expires.

She cannot apply to become a Permanent Resident from within the US based upon marriage to you as there is no immediate visa number available for wives of Permanent Residents. As a Permanent Resident you can sponsor her as your wife but she needs to wait outside of the US until a visa number is available for her.

If she remains here until there is a visa number available, then she will incur a 10 year ban when she leaves the US to have an interview - and she will not be allowed back into the US for at least 10 years. If she remains in the US illegally she will not be able to work or get identification or participate in the US society. If she is caught, she will be deported and more than likely banned from ever being allowed to return to the US.

The fastest way to get your loved one here is to get married, submit the I-130 petition for her and then the both of you wait - you in the US and she outside of the US. Sadly, there is no way to get around the waiting.

She needs to wait outside of the US until one of 2 things happens:

a) a visa number becomes available for her and she will be invited to apply for a CR-1/IR-1 visa or

b) you will be here long enough to become a US citizen and can update the status of the I-130 petition, which means a visa number will be available right away and she will be invited to apply for a CR-1/IR-1 visa.

Whichever option you chose you will have a multiple year wait. There are no shortcuts unless the legislation changes to allow immediate visa numbers for wives of Permanent Residents in addition to US citizens..

One last comment - why do you say "i want to make with her a mariage here in the city hall like i meet her first time here in USA ."? Do you mean to pretend that you only met her the first time in the US instead of knowing her for a long time, or do I misunderstand your meaning. There is no reason to pretend and if you lie about something big like this it will definitely cause a problem for you in the future when it is time for her to immigrate.

There is nothing wrong with getting married to someone you have known for a long time while they are visiting in the US. It only becomes wrong if you try to use this as a way to bypass the proper immigration process or to lie about it.

Have you thought of moving to her Country?

Or both moving to yours?

You said you're a permanent resident - how much longer do you have before you can apply for citizenship? Honestly, depending on the wait time, you may find it safer and more effective time-wise to just continue to date (she can visit on a tourist visa if she can get approved - which she will probably find much easier if she really IS just coming to visit a boyfriend, NOT coming to get married), and you can go visit her. Once you are a citizen, a visa will be immediately available for her and then you can bring her on a K-1, or get married and bring her on a CR-1.

Having her come here pretending not to know you and then suddenly getting married is not only fraud, but will look very odd to USCIS down the line when a visa is available for her and you petition for her and have to do your interview and your entire story is a lie. That will not end well.
