Dear Visa Journey,

I am new here, not sure if that's relevant or not. i come here today seeking advise as to what i should

do about a person whom i have reasons to believe obtained their immigrant visa by fraud, i have their names

and phone numbers, addresses and a lot of information about them, because the woman involved is my friend

i do not have physical proof that they committed visa fraud but i know because i heard them talking about

it. the problem is the woman already received her visa,it is conditional but she has been married for over 2yrs

and so i heard her on the phone telling some one that she can change it to the 10yr green card once she is at her

port of entry, (is this true??) and if yes can i still report her and have her arrested and turn back at the port

of entry??

i know y'all might be thinking why i am doing this to my friend, but i do not condone illegal activities

full stop! nothing else to it.

If they have been married 2 years now, and enter the USA on a CR-1 visa after 2 years of marriage then the resulting GC will be un-conditional.

Strange topic, could make an anonymous call to ICE, however I suspect seeing 2 years of marriage, and the consulate approved the visa, that nothing will come of making a report, more than likely they will think you have a problem with your friend, and are out to ruin their marriage for some reason.

I would simply leave it be..

really what does that have to do with the fact that she committed an illegal act?? is the system

Without some kind of hard proof it sounds like "sour grapes" and will probably be ignored.

well how do i make the grapes sweet?? what if i engage her in a conversation on the phone

and get her to admit paying him money, or some thing that would substantiate my claim, will

they turn her back then??

Again it would be your word vs them, and since they have gone through the process with USCIS/NVC/Consulate, and red flags did not come up throughout, they will tend to believe the immigrant, unless you could provide them with solid evidence to over-ride the decision of the consulate.

Keep in mind there are laws in some states and countries about taping people without their knowledge, and this could get you into trouble.

that's correct. Better tell her that she is being taped and have her state her full name at the beginning of the recording session or the tape is inadmissible as evidence.

You can report them and that is all you can do. You will not be informed of anything after that.

Fraud is not handled the same as reporting someone who is in the US illegally. You will not have anyone deported. Marriage fraud actually requires that USCIS prove the fraud in a court of law. Proving something requires evidence, not suspicions.

Keep in mind when there is overwhelming evidence in these cases, the green card holder may choose voluntary departure over court, while the US citizen can face charges of up to 5 years in prison and a fine of up to $250000.
