You can leave your family in one city, and take residence in another city, that doesn't change residency rules. Fact of the matter is, he has not been a resident of Chicago since he started at the White House. The court is putting his name back on the ballot because it is much easier to disqualify him after the fact than it is to deal with lawsuits and injunctions right before the election, or lawsuits and injunctions to nullify the results afterwards.

yeah. He left, rented out his house and filed his IL taxes as a part year resident. When the part year resident thing came out he amended his return to full time resident.

After reading the text of the court order, it appears to me that the court is simply stating that no ballots can be printed without Emanuel's name on them until the Supreme Court rules on the case. That doesn't mean they are allowing his candidacy. It just means they want to keep the options open while they decide the case. If the ballots were all printed without his name on it and they came back and allowed his candidacy, it would be too late.

Of course, according to Bush v Gore, the State Legislatures, not the Courts, are the final arbitrators of elections occurring within a state, things may not be finalized until after the election is held.
