They are eligible as K2's for a SSN on the same basis that you were for yours.

Tell them to show you the Federal Statute, they can't because it doesn't exist. I added Anna & Gabby (our son) 2 months prior to their entry. Not only did they not have SSNs yet but they weren't even LPRs!

I went to the Social Security office the day after our wedding with the certified wedding license in hand and they would change my wifes card to her married name because married she was out of status for her K1. Tried to get a Social Security Card for my daughter same day and they would not assign her a number beacuse of out of status. Social Security office explained to me that banks and hospitals and medical insurance likes to use Social Security Numbers but that was not the intended purpose for issusing of Social Security Numbers.

My HR office was able to issue medical cards for my wife in her K1 name and issued a card for my daughter without a number. My son just arrived from Colombia and I added hime to my medical without a number. The IRS will issue a Tax Id Number which I may need to file taxes next year because we are going to adjust the sons status later. He needs more vacienes.

Have your husband talk with his HR department. I have BCBS health insurance, After explaining to my HR department about my wife coming on K-1 Visa all I had to do was show proof of our marriage cert and she was added immediately without her social security number. When her social security number did arrive it was in her maiden name, With this said, she was on my insurance for about 1 month just using her maiden name, When her new social security card arrived showing married name the changes were made to my insurance plan.

You just need to find out if his insurance plan allows one to be added without the social security number.

From http://www.ssa.gov/pubs/10096.html

Lawfully admitted noncitizens can get many benefits and services without a Social Security number. You do not need a number to get a driver’s license, register for school, obtain private health insurance, or to apply for school lunch programs or subsidized housing.

Some organizations use Social Security numbers to identify you in their records. Most, however, will identify you by some other means if you request it.

We cannot assign you a Social Security number solely so you can get a driver’s license or a service that requires a credit check.

Although many companies, such as banks and credit companies, may ask for your Social Security number, you are generally not required to provide one if you don’t have one.

No they are not. A K-1 is eligible based on the K-1 status, and only needs to provide the unexpired Form I-94 as evidence. K-2s are not eligible based on status. They need either an I-766 EAD card or I-551 stamp or card.

It is almost impossible for an alien to be assigned a non-work authorized SSN, so that pretty much out of the picture as well.

Tell them to show you the Federal Statute, they can't because it doesn't exist.

Which Federal Statute, for the insurance company, or for SSA.

The Privacy Act covers government use of SSNs, but it doesn't cover private companies.

Legal requirements to provide your Social Security number:

http://ssa-custhelp.ssa.gov/app/answers/detail/a_id/78/kw/

The Privacy Act regulates the use of SSNs by government agencies. When a federal, state, or local government agency asks an individual to disclose his or her SSN, the Privacy Act requires the agency to inform the person of the following: the statutory or other authority for requesting the information; whether disclosure is mandatory or voluntary; what uses will be made of the information; and the consequences, if any, of failure to provide the information.

If a business or other enterprise asks you for your SSN, you can refuse to give it. However, that may mean doing without the purchase or service for which your number was requested.

SSA assigns SSNs based on:

CFR Title 20 Part 422 Section 422.104 Who can be assigned a social security number:

The OP said the Insurance provider is claiming that a Federal Law is requiring them to have SSN in order to get insurance coverage. The quoted law makes no such requirement.
