Speaking of taxes, if I file as "married filing jointly" for 2010, how will the Dept of State evaluate the return as evidence of my income, since my wife's income can't be counted? Our income is accounted for on different lines on the 1040 (hers is wages mine is self-employed business income), so I would think they will see on the form that my income alone is sufficient.

Since taxes aren't due until April 17th, and hopefully we'll be sending in that AOS package well before then, how can they expect us to include 2010 taxes? I will just send 2009 taxes.

That's what we are banking on. The last three years hopefully, will be fine without 2010.

I think I will still include photocopies of my W-2s for 2010, if not a copy of what I plan to file, even if I haven't submitted at that point.

That's what we are banking on. The last three years hopefully, will be fine without 2010.

They won't expect 2010 taxes with the AoS package until after April 17. Up until then, only 2009 is expected. But if you made more income in 2010, it'd be a good idea to include some kind of proof. My husband made double in 2010 and although we won't have his taxes done before we send off the AoS package, we're definitely sending proof he's made a lot more in 2010 and is still making that much through an employment letter and his pay stubs.
