I130 filed in May 2010 and no NOA2 as of yet

well you at almost 6 months now, what does the USCIS site say about your petition? have you called USCIS to make an inquiry into status?

May 15 2010 -- The Wedding in Castlemain, Victoria Australia

June 22, 2010 -- Mailed to Chicago lock box

July 5th recieved NOA1

Nov 1 2010 Case transfered to Texas Service Center

Nov 24 2010 Case Transfered to USCIS Office ???

Feb 7th Changed address on USCIS web site

Feb 17th Wifes case approved

Feb 18Th Step-Son's case RFE

Feb 27th Both Cases put back into "Initial Review"

Mar 28Th Case approved at USCIS

Apr 14Th AOS Fee Paid

Apr 19Th IV Fee paid

Apr 19Th AOS packets Sent

Apr 21St IV Packets Sent

May 19Th RFE for Wife IV Recieved

May 19Th RFE for Stepson IV Recieved

May 22nd RFE reply for wife and stepson sent to NVC (Overnight)

I called two days ago and they said they would put in a service request and that I should hear something withinn 30 days. I don't know what to think or assume, all we can do is wait.

I did the same thing and one week after I opened a service request, they approved our case. Good luck.

Thank you for your info regarding this, it helps to know others have been on this same path and we must be patient when it doesn't go textbook according to other timelines.

Where did you file?

FWIW, we filed on May 18th with CSC and I was losing hope quickly, but just got I-130 back last week.

On the timeline http://www.visajourney.com/timeline/ it shows CSC is processing May 28th applications for CSC I-130's for IR-1/CR-1 and K3.

Good luck, and if you happened to put your email address on the I-130 like I did, I got my NVC case number, invoice and DS-3032 via email four days after I received the NOA2s. :)

I filed at CSC, my attorney did the paperwork for me. I will just be patient, thats all I can do or Ill drive myself crazy thinking negatively. I know Im not the only petition that has gone this long for an answer, our day is coming on the day its meant't to be.

There are still several May filers without NOA2 yet and we are part of that also our notice date was May 11, we already put in a service request Oct. 18 they pretty much ignore you if you call them and it hasn't been 30 days as I tried to call USCIS this past Friday as I haven't heard any new news and also contacted congressman on oct. 21 they told me two more weeks? received two touches on Oct. 21,22 and I can only hope that meant something as case status still says initial review which isn't reliable. I hope the remaining May filers left in the dark without an NOA2 can find some resolution soon, good luck~

Maybe we are all stuck on the same persons desk :) It drives me crazy seeing other dates that filed past mine/ours and they have received their NOA2, happy for them, but makes me worry, thats all. I wanted us to have Christmas here in the USA, I guess that window is closing. Our son is suffering from the separation from his Dad and I can't get into the spirit of anything. 11 years married and this is our first time apart, sooo hard.

Question: What can a Congressman really do except inquire the same way we or an attorney does? Do they have any kind of influence on the petition being processed?

Has your case even been touched since your NOA1? Our Notice of receipt date is 5/7/10 and it was last touched on 5/11/10 (probably when it was put on the shelf :( ). There doesn't seem to show any activity and no request.....Just can't believe it.
Most case don't get touched at all. Mine was touched once, the day before approval. You need to contact your senator's office using the above guidelines I posted.
