hi.

i need to ask as i am feeling so lost.

i am in the uk and my hubby is in usa and we filed the I-130 - 34 days ago now. we had the NOA1 about 10 days after and now we wait...but for how long til something else happens?? is the USCIS process the longest part of this? the I-130 is all we have done.

we are applying for a IR1 visa, we have been married longer than 2 years.

everything with our application should be straightforward and i am getting the forms/police cert and other things sorted on this side ready for the next part...

the last touch of our application was the 17th september...i think they pushed it down the back of the desk and it dropped it on the floor and kicked it under the desk where it now sits, as lost as me!

i asked my hubby to call USCIS but he says he will only get someone looking at a computer screen and seeing the same as what we can see on the 'status page' of USCIS website....like the last time he called them regarding the initial RFE we had (which is now sorted)

is there anyway we can find out exactly what is happeneing?

this is driving me nuts.

its driving him nuts.

and its driving everyone around us NUTS!

2004 - we met online.

7th May 2007 - filed I-129 paperwork

9th June 2007 - received I-797 notice of action

13th November 2007 - I-129 approved

18th December 2007 Visa and medical interview

12th January 2008- Shipping company arrived

14th January 2008 - landed at Newark Airport.

9th March 2008 - got married(received SSI number)

April 2008 - My things arrived in USA from the UK

9th March 2009 - our 1st Anniversary

14th June 2009 - returned to the UK

9th March 2010 - our 2nd Anniversary - spent apart - so lonely :(

1st September 2010 - filed I-130 (applying for IR1)

11th Sept - Received I-797c address part C error

13th Sept - Resubmitted I-130

24th Sept 2010 received second I-797 NOA status - "initial review"

4th January 2011 - I-130 Approved - moving to NVC!

12th January 2011 - I-130 forwarded to NVC.

31st January 2011 - Notification of LDN number received in the post.

Everything that I've read says that you should expect a 4 - 6 month wait between your NOA1 and NOA2.

You will have to learn to wait because the Visa process takes many months. It took 4 months before my I-130 was approved. Then you have to get through NVC. After that you wait for your interview appointment. It's a waiting game.

Have you enquired via email after the RFE - did you get a response giving a time frame.

We just recently responded to an RFE and emaileda few questions to the CS.

It pays to call the USCIS more than once to speak to a Tier 2. In my experience, its like getting an insurance quote. Sometimes you will get someone really helpful at tier 2, and others they just read off a screen without bothering to investigate. Always make a note of every tier 2 that you speak to for future reference.

Yuo can ask to speak to their supervisor too, though the chances of them being available are pretty slim. They do have a voicemail...yet Ive not had a call returned by them

I know its hard waiting, especially with Christmas coming up etc... so i feel your pain. We put in for an expedite for a number of situations, and we're waiting on that. In all honesty, Id rather be in a normal situation and wait rather than been in this position and have to worry about everything as well as the expedite, but theres not much you can do.

Your looking at Feb or March of next year. Then another two four months to get visa,,,that's if there are no hang ups with Uscis...Just sit back and relax,,and or maybe take a trip or two to the UK. Godbless and takecare!!!

Sometimes a failed expedite request may add even more time to your wait!!

I found the statistical data gathered on this website was very helpful to me in terms of framing my expectations for the process. Take a look at the data for your visa/service center at this link:

As you can see, people who are just recently having their I-130 approved this month waited about 150 days on average. The estimate at the bottom of YOUR timeline is based on this information. It will get more accurate the closer things get, but based on current data, your approval shouldn't be expected until MARCH. Then, people have spent another ~3 months processing at the National visa center, before going on for the interview at their embassy. Links at the bottom of the page will take you to more detailed data, you could put it in excel if you like that sort of thing and see the fastest/slowest.

At the top of the page there is a blue bar with links in white text. On the right hand side (stretch your screen sideways if you don't see it - the text wraps funny) you'll see "Immigration Timelines" click on the link for "Igor's List" and then use the drop downs for your petition type and service center. I spent a lot of time checking the chart on the right, because you can watch them as they get closer to approving your petition. When the bar for the month you filed starts to go up, you can start looking for your NOA2 to come in the mail too!!

I'm sorry there's not better news to give you. Hang in there, all of us on VJ went through this painful time of separation and made it through, you will too!

Of course, when you're looking at all of that, keep in mind two things: Not everyone going through the process is on VJ or reporting their dates, so this is not absolute. However, I believe that it is a decent sampling. The second thing is that sometimes people are on VJ a lot while they get started, but once they get their approval, it's just not a priority for them to come back here and update things, so there are open-ended time lines out there as well.

K-1:

Currently it's taking 160 days to get CR1/IR1 approved. For you it's only been 34 days. If you are freaking out now, I'm going to point at you and laugh at you in a cruel manner.

How much evidence did you send. It makes me wonder...if you send a mountain of stuff it may take longer to adjudicate a case. It stands to reason, if you have airline tkts, affidavits, photos, etc IN ADDITION to the basic required documents it would take them longer to go through.

My theory is that immigration fraud is so high that they have had to impose the guidelines worldwide. Whereas if someone if filing from Canada, UK, Italy, they may not need as much required evidence of a bonafide relationship as much as so called high security countries.

The combination of both could potentially cause mayhem at the service centers. I dont know, just an opinion, may not even apply in our cases.

I got an RFE for an invalid copy of something required. Basically we sent the bare minimum really.

Although when I originally filed for the K1 visa - we sent a rainforest's worth of evidence.

I guess its getting the balance just right, but I feel your pain and theres not much you can do - although if you do call,Id advise speaking to a tier 2. At least you are guaranteed SOME form of information

Hi. We are in the same boat as you except we were only married in June of this year. You wait, and you wait. timeline shows in California Service centre the processing to your NOA2 will be approximately 5 mos, then it get sent to NVC where it will sit and you will wait again. I am not expecting to be with my hubby in the USA within the next year and if it is sooner than that is a bonus. Thank God for Skype is all I can say.

you need to wait its been only 34 day just give it sum time calling dem is a weast of time.. don't let it drive u crazy just stop checking the update an it wont, just fine sumthing to do that well keep ur mind off it ..

Ah, man...you are so correct. Go on with life and days turn to weeks and weeks to months. Just hope months don't turn to years. Follow the timelines.
