hello to all VJRs i am a filipina and i have a u.s citizen fiance.and we filed KI fiance visa, here in philippines us embassy we are required to pass I-134 as affidavit of support. and I read in travel.state.gov that the in applicants using I-134 the income requirement is only 100% of poverty guideline,is this the right information?please help and what is the 100 %federal povert guideline for househodl of 2? thank you so much in advance please help...

Yes and no. There is no "requirement" for the I-134. Many consulates use the I-864 as a guide and for family based non-immigrant visas the requirement for the I-864 is 100% of the pverty guideline. That is true.

It is also useless information.

The consulate's requirement is to determine that the visa applicant will not be a public charge. They can do that ANY WAY THEY WANT. There are no "rules". It is a judgement call. Period.

The other thing is that once you arrive, as a K-1, THEN you have to do another affidavit of support and for THAT one, you need to have 125% of the pverty guidelines, so many consulates apply that rule to their decision, but they can still do whatever they want on a case by case basis.

If your fiance is "borderline" he needs to be looking for another way to make some money. get another job is a good way, a second job. Manilla takes a dim view of co-sponsors for K-1s.

100% of the poverty line is for military only acording to the poverty guidelines. Everyone else is 125%.

125% for both I-134 and I-864 unless the USC is in the military then it is 100%.

No. The 125 percent minimum income requirement, the most recent year's tax return and other requirements only apply when an I-864 is needed. Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA.

The requirement for a family of 2 (you and your fiance) is $18,212. This will be based on his current income...not his last year's tax return.

What is his current income?

his current income in the new employment certificate he has,he is earning 3000 monthly starting this september..is the one i read for KI visa in travel.state.gov stating the required income for applicants using I-134 is only 100%poverty guideline and 125% is only used when I-864 is required,is this not applicable now?...we dont have income tax return for 2010 yet,only 2009 and that year he was affected by recession.. he just recover just this year what we have now is employment certificate stating his postion and his mothly income as of this year starting september..thank you so much...

What about from his previous job? What were his earnings from January 2010 up to August 2010?

100% of poverty guideline for a family of 2 is $14,570...still based on current income, not previous year's tax return.

If his income is $3000 per month, he qualifies. Find something else to worry about.

His 2009 return will not matter, attach it, but don;t worry about it. You do not need the 2010 return if your interview is before April 2011. CURRENT income is waht he puts on the I-134 or I-864. He has plenty.
