Need some help - received letter

After our interview on the 26th of august - we finally received a letter stating we have 30 days to submit more evidence of our marriage or we will be denied the AOS of my husband.

Anyone in the Huston area know of good laywer ?

The letter was address to me under my maiden name and not to my husband, it stated they would revoke my k-1 visa - is this normal?

Isn't our k-1 finished ?

It stated we missed 3 out of the 20 questions asked during the aos interview and this is what he the officer is basing it on.

I am already in process of getting statements from friends that have known us though this whole process. We took our lease, joint checking and saving account, joint filed taxes for last year, I carry my husband on my medical at work and he is my beneficiary on my life insurance. Plus our car insurance is with both of us on it.

I am not sure what else we can submit except maybe letters from both of us with the reasons we did not match on some of the questions (?)

With the economy these last 8 months - with 2 layoffs and struggling to keep a roof over our heads and then the stress of finding a job because of the support and visa reasons - we have dealt with more then most couples would in life time. And many would of not made it though.

If we are denied - what are our options ?

Let me get this straight:

- wife = USC

- husband = immigrant

If this is the case and you, as the USC received a letter that YOUR K1 would be revoked, that's very weird because you don't HAVE a K1 visa, you're a USC... If you meant his K1 visa would be revoked this is also odd but I suspect that this letter was sent to you to prove you live together or something like that. Perhaps giving you the chance to not respond in case they think you're being pressured to AOS him or something...

Worst case scenario and you're denied, you can appeal the decision. it means more money though so get everything you can to prove a real relationship. It seems like there's some red flag that you might not know about. You said 3 qns out of 20 wrong, so does this mean you had a stokes interview? Any idea what caused the stokes? I.e. what made them think you required one?

Yes we did have a strokes interview - we were not aware of we would but should of known. We got the letter for the interview on the Monday before the Thursday interview. They had sent it to the old address. We had gotten so comfortable with each other as things are finally on even keel with work and income and relaxed a bit with this whole process - did not even consider this even though we should of known.

We have a age difference - I am older than my husband by 20 years.

Well Marc Ellis has an office in Texas but he is in Vietnam, I know it sounds weird but he is good. He just got my husbands denied Cr1 Visa reapproved and on its way back to the embassy. www.marcellislaw.com

Do u have any utilities both under your name like cable bills, water bills, phone bills, any receipts both under your name to prove more........What are the 3 missed question that didnt uniform to answer both of you?.....Just pray im sure God will guide you on this journey.......

First of all calm down as best you can. Panic never creates good decisions. Go through what you provided for the interview and think of what you might add. Did the two of you draw up a will naming each other as beneficiary ? Do you have life insurance in the others name ? Are you on the same medical policy ? Has anyone sent you an invitation to something as a couple ? Do you have cell phones on the same plan ? Do you go to the same doctor/church/??? Have you gone anywhere since the interview on a trip and taken pictures ?

This will not be over quickly. You will not enjoy this.

gather as much evidence as you have. if you hire a lawyer look for immigration lawyers but be careful because they do not care if you approve or not since some are dishonest. some answers you gave at the interview did not please the adjudicator perhaps that was happened you know better . i think you will have a positive outcome after all.

Thanks for the input - the officer never even took into consideration what we took in which we had -

org. lease in both our name started back in Feb 2010,

our joint checking and savings statements we opened in Jan 2010,

our car insurance cards with both of us listed as drivers,

our joint income tax filing for the yr 2009 - we got married in december 2009)

our dental coverage from my work ( i cover him under dental as this is what he needs most but we can't afford the health insurance right now)

will get copy of my life insurance though work showing him as my beneficiary dated from when my benefits went into effect

I am gathering statements (notarized) from everyone we know

I don't know what else we could use - this is about all we have

He miss the question of how much my annual salary is but he did know I get paid 2 times at month and knew approx my bring home pay. But this was one of the things cited in the letter.

we missed our fav place to eat - i said i do not have fav place and his is soup and salad - my husband said cici's pizza for both of us - we live out in bfe between Galveston and Houston - and is cici's is only place we could afford to go out to eat many months w/ coupon from back of krogers receipt ..lol

we did not match on what we did for our birthdays nearly a year ago - i drew a total blank when asked and told the officer I did not remember but he pressed for a answer so i said we prob stayed in as was during a lay off time. but my husband remember we went over to my daughters and had dinner with them

more recent events we both matched answers like vacation and job descriptions, etc

The key is never ever let them get you rattled. When my now husband had his second interview with Lago's infamous Asian lady she wanted to know what my parents did , he told her that there were both dead and they do whatever people do in heaven.

This will not be over quickly. You will not enjoy this.

Your proof are very good already!..If i were in your shoes, i send the same stuff of what u sent to them but this time add the "affidavit from friends" to prove that your marriage is in good faith...sometimes, they trying to bully you most especially if there is a big age difference. I know both intentions are real, but in the eyes sometimes of an officer they see as fraud or marry for greencard....To think that those missed questions are so simple. If u have some junk-mails there address both of you or to your husband, include that too! anything that shows both names or your husband of which he is the applicant,right?

i have been going over in my head what else we could send - and will also include old job health and dental cards I carried on us both at last lay off job where I could afford to carry health insurance back in march, also too we went to one of those resorts that offer a "free trip and 100 visa gift card" for listening to there spill back in feb - we had to be a married couple to attend :D

plus also our premarital work shop scrapbook we made attending the premarital class before we were married - was exercises about writing what we loved and thought might be a "problem" down the road (was a very good weekend class everyone should take this,)

we did not enter into our marriage for it to fail - we worked to hard to make it come true in the 1st place.

2. Also, do you guys have the same address on your ID's?

3. Perhahps you should reprint your joint bank account history?I hope you use that frequently for your bills.

It's pretty unusual that you guys got a stokes interview. It is unfortunate. This rarely happens to people who come here on an approved K-1 visa.
