Hi. New here. We received an RFE this week. It said, 1. submit latest tax return and underneath it, 2. a box was checked saying my husband does not meet the sponsorship's support financially. How come? He earns 56K a year for 7 years? Please help what shall we do?

create a new I-864, give 3 years of tax return data.

I'm guessing the I-864 was scant.

It may be he is 'supporting' people , and wasn't noted somewhere, but USCIS caught it. (that's a wild guess).

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

It sounds like they want the 2009 return.

What does line 22 on his tax returns show for income? Does that meet the requirements for your spouse's household size?

I'd have hubby call IRS and have him get his last 3 years of tax transcripts and send them in.

Free. Call 800 829 1040.

He can have them faxed to him while he's talking with them.

Also he can have them mailed to him. Takes about 7 days if mailed.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

So, did you submit the tax return for 2008? Or Tax transcripts (Both acceptable, I would thing transcripts are preferable)? This is required. If you have done 2009 taxes, you can send those in IN ADDITION to 2008. Be sure if you are sending in the return you send in a copy of all schedules, the 1040, all W-2s, 1099s, etc.

56k might not be acceptable if there is a large household size. If it's just the two of you, then he meets the qualifications, but you haven't proven his income very well.

Here are the ways to prove income:

- Tax returns (or transcripts) for the past 3 years (only latest is required)

- Employer letter (stating job title, when they started, permanent or temporary, their salary)

- Recent pay stubs (I included the math for how to get from one pay check to a whole year's worth)

Oh, I almost forgot, if you sent all of this stuff in already, and you still got RFEd, you may need to send it in again because they are notorious for asking for things you've already sent! :wacko:

Thank you friends. Yes we've sent all, tax transcripts, w2s and even the 1040 and w2 for 2009 since we already filed tax electronically.

Do I really need to send a new 864 form together with what they want?

I decided to HIGHLIGHT the line 22 of the latest 2009 tax and the 06, 07 and 08 tax transcripts taxable income against the USCIS Income guidelines. Is this good?

We're only 2 in the household size...

Yes, send that all in again, and include the other proofs of current income if you can.
