MY IMMIGRANT VISA HAS BEEN APPROVED THEY GIVE ME PINK SLIP BUT IN THE NEXTDAY AFTER MY INTERVIEW USEM MANILA CALLED THAT I NEED TO GIVE THEM I 864 BECAUSE THE FORM I GAVE TO THEM WAS FOR FIANCE VISA WHICH IS THEY PROCESSING FOR IMMIGRANT. MY QUESTION IS WHY THEY GIVE ME A PINK SLIP AND PAYED THE AIR 21..SINCE MY REQUIREMENTS IS NOT COMPLETE.. IT MAY NOT AFFECT FOR ISSUING MY VISA? AND ANYBODY HAS EXPERIENCE LIKE THIS???

PLS TELL ME... THANKS!!

So you gave them an I-134 instead of the 864?

Yes - in a CR-1 - you need the 864, since it is legally binding, as the 134, not so much.

Since the information is same (income level/transcritps/job) they are waiting for the 864 from you (not an outright denial). (they probably caught it at the last second)

So give them what they want!

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

What kind of visa did you apply for? Was it a K1 or K3, or was it a CR1? The K visas are non-immigrant visas - you enter the US as a non-immigrant, and become an immigrant after you apply for a green card. The CR1 is a an immigrant visa - you are an immigrant the moment you arrive in the US.

If you applied for a K1, then the consulate is probably mistaken. As far as I know, Manila uses the I-134 for K visas. In that event, I'd contact the consulate and ask them to verify whether you really do need to provide an I-864.

WE APPLIED K1 AND K4 AND ITS BOTH APPROVED THEN USEM SAID THEY WILL PROCESS THE CR1 BUT MY HUSBAND AND I DIDNT KNOW ABOUT 864 THING.. BUT MY HUSBAND IS WORKING ON IT NOW..AND THE 864 IS ON THE WAY :D THANKS!! MY CONCERN IS HOW LONG THEY RELEASE THE VISA AFTER I GIVE TO USEM THE FORM THAT THEY NEED.

Sounds strange. Somethings amis.

But - you know what? at the end of each day, at the USEM, the casefiles are reviewed for accuracy and completeness. A USEM staffer 'caught' this, and now you're required to send it in.

I'm really confused about what is what, from reading yer posts.

If it's a K3 and K4 - ya, those go together.

A K1 and K2 go together.

Now you mention a CR1 ? I suggest maybe, the I-130 petition was just a few days behind the K-3 at the USEM.

Suggest you have the USC call the DOS HOTLINE and check on case status, for all of the petitions that he's filed on your behalf.

it would probably just take longer than usual to give you back your visa/passport but at least you were assured of an approval/visa.

just be thankful that it's them who messed up (hehe), and submit what they asked. you're almost done.

thank you!! yeah that's my husband thought too and need more patience since that what they is not that heavy problem but still annoying cause why they didnt tell me during my interview sooo i process it on time also.
