hi everibody,

i dont know if here is the place to post this topic, but i just got my 10 years green card - 4 months ago!!!!

my husband wants a divorce, we ve been fighting like crazy, i m moving out of the apartment at the end of the month. but yesterday he told me that when we get divorced our marriage s gonna look suspicious, because i just got my green card and and the Irs or something like that he said will send me back to my country!!!

I m so scared !!! is that true, can i be kicked out of the country !!!

Please any advise highly appreciatted !!!

No, you can not be kicked out of the country.

You are now a permanent resident. He can't do anything to try and get you out.

You have your 10 yr greencard, your conditions of residency have been removed unless there is a finding of immigration fraud it sounds like a "scare" tactic that has no merit. Nobody will be coming for you.

No you wont be kicked out of the country ..BUT , when you file for your citizenship , make sure you file it after 5 years from the day you got your first conditional green card (the one which was valid for 2 years)

Because if you file citizenship in 2 years and 9 months which most condtional residents do after getting ther 10 year GC there can be some issues , since a person should still be married to the us citizen spouse if he or she files citizenship after 2 years and 9 months

impossible to be deported because of only divorce after holding 10 year gc.

Just make sure you collect some evidence in case during naturalization (if you plan to become a citizen) they ask. If there has been serious domestic violence, you can call the cops and file a report. However, to answer your question - no he has no power to get you kicked out of the country. you are a LEGAL permanent resident now.

Not sure it will be relevant at all: I mean even if they question it...it is not like because he was violent it makes it okay :P As long as they divorced after she got the GC not during or before...

MOve on with your life now, that 10-card is permanent resident status and you can get far away from your ex as possible.

Nothing to worry about. You are a legal permanent resident and there is no reason to stay wit the brute if he is abusing you. I you apply for citizenship in three years (total five from your original conditional permanent residency date) you may be asked about the conditions of your marriage and separation/divorce but it will not be a bar to you.

On a separate note, my wife became a USC and had a baby within two weeks of each other last summer. It made the swearing in ceremony a bit more exciting!
