Correcting myself: there will be a 10 year ban for more than 1 year illegal presence. If the husband has had more than 1 EWI instances, the ban would be a lifetime ban. More precisely, here's the deal:

When an alien enters the US as an EWI one time and stays in the US more than 1 year, he faces a ban of 10 years. This ban is generally waiveable immediately with an I-601 waiver. The law that describes this is INI 212(a) (9)( B) .

When an alien enters the US as an EWI and stays in the US more than 1 year in aggregate, then leaves and enters again or attempts to enter again, he is banned for life. This ban can generally be waived with an I-601 waiver but not until the alien has first spent 10 years outside the US. The law that describes this is INI 212(a) (9)©. There are a few exceptions to this rule- see exceptions to (9) © below.

Yes, he faces a 10 year ban...not new news for us. And he has never left and returned and never been arrested. He has family members that were ILLEGAL for more than 20 years, and they spent less than 4 months in Mexico before receiving their Visas. EVERY SINGLE CASE IS DIFFERENT.

Hello,

I am brand new to this site and don't even know if I am posting correctly!!

Anyhoo, I am the Petitioner on my Mexican husbands behalf. I filed the I-130 in June 2009 and we received his Interview appt on November 27, 2009. We have one way tickets to El Paso leaving the 18th. His Interview is the 23rd. I have been told MANY different things and am soooo CONFUSED. I was told by some that as his Wife and Petetioner that I was required to go and now others have said that I do not. He has been here illegally since 1998 and we have been together since 2006. We have one child together and another on the way. My Husband doesn't feel comfortable traveling alone thru checkpoints and has no idea which papers are which in all our mounds of paperwork. I figured sending him alone would be like sending him to swim with sharks!! Can anyone give me any insight or help?? We are expecting him to have to stay behing in Mexico for up to a year or possibly more since he entered illegally, but does anyone really know from their personal experience? We have been told so many different things and have done everything on our own without a Lawyers help. Like what happens at the Interview? After the Interview? What is the waiver for? Does he need to make an appt for one, or do they tell him that in Juarez? I am just so worried and feel like we are entering the unknown...ANY help would be greatly appreciated..

I just returned from Juarez with my SO. You as the Petitioner are not allowed in, but I went for moral support and believe me they need it. I personally do not have experience with the Waiver process, but I here this website is great immigrate2us.net. Many people have found lots of information on that website I hope it helps. Once you are in Juarez there are plenty of people going through the same experience as you so don't be afraid to ask them for advice. I am sorry I don't have more answer for you regarding the Waiver process, but if you have questions about Juarez please feel free to ask.

I do not know -or care- how your husband -or anyone's husband- comes and remains here illegally for 11 years. All I care -and told you- is that it will be a very hard road for you both. And also that if gives people like me, Mexican citizens with nothing to hide, a terrible reputation thanks to folks who "cross over". So not one iota of sympathy.

And you might want to rethink the use of ANGRY CAPS, as it just causes much more hilarity and will only contribute to you becoming more alienated from the VJ members who can help you. You guys are in a sh1tty situation of your own making, so be angry at yourselves, not at anyone else.

To answer people's questions about legal family immigration.

You are looking not only angry, but childish. You need all the help you can get, so you might want to consider toning down the anger.

In a nutshell: your husband will be denied and you will need a waiver. Have you read what you need for that? Or would you rather engage in a pissing match -which you will lose- instead of moving on to the real issue of how to file a successful waiver?

Your choice. If you don't need help, there are plenty other folks on VJ who do.

Whatever reason anyone has for entering this country illegally is immaterial. It happened and that is all that USCIS will care about. Getting upset and insulting people who give you advice that isn't all rainbows and unicorns won't get you anywhere. You can keep looking for people who will validate, or you can get real and ask questions about the tough road ahead. There are plenty of people on this board who are very knowledgeable, but be forewarned, not all advice will be pleasant to your ears.

OP you're burning bridges w/ ppl that are trying to help you. And it sounds like you need all the help you can get. Alot of the ppl you have engaged with in arguing with are pretty knowlegable ppl you are marginalizing yourself from. You have entered a forum in which most if not all ppl here are trying to immigrate legally. The USCIS is not going to give out hugs to you, so think of this as "boot camp". Ppl come across harsh, and sometimes crass becasue this is the nature of the beast.

Think of it like this. You fall overboard on a boat, you are struggling to swim. Someone come's in the water to save you. Chances are the person saving you is gonna not going to exchange formalities and pleasantries. It's gonna be more like "Hey you! take the effin life jacket or you're gonna drown" type responce.

OP I know you are upset, but try to tone down the anger because you won't get answers that way. I don't agree with illegal immigration, but I know it happens and I don't think Chica was trying to belittle you in anyway. She was just warning you of what could happen. I think you do need to be aware of the ramifications of his illegal status. You have to understand how some people may get upset because they did everything legally and it makes them mad when someone doesn't not follow the law. You should just learn to accept that not everyone is going to give you sweet answers to your questions especially if an illegal immigrant is involved.

Chica is trying to help you and others will too, but try not to get so upset. I know her words might have upset you at first, but then she clearly changed her tone so you should try doing the same.

I really hope you do find answers here because there are very knowledgeable people, but you need to be prepared to get comments you might not like just don't let it upset you.

It's not that people don't know why people immigrate here illegally from Mexico, or whether or not in their minds they have a 'valid' reason, it's that it is a crime. Trust me, I know the situation for most in Mexico and it's not pretty but that doesn't justify breaking US laws IMO.

For example, the police will still arrest someone for stealing, even if it was to feed or clothe their family. Unfortunately breaking the law has consequences, for whatever reason (good bad or indifferent) it may be.

This will unfortunately create a difficult situation for you and your husband and you will need a waiver. There are many couples on this site who wish to immigrate the right way and undergo extreme hardship and separation through this process. There are others who have legitimate relationships and have their visas denied only to spend more and more money and time going through the process more than once.

Just as you wish for people to sympathize with you, the sympathy goes both ways.

Hope I shed some light on the subject

In the middle of a financial crisis where the local state and federal governments are in serious deficits, where we are cutting programs in our schools, where thousands and thousands are unemployed, illegal immigrants are working and living in the US and not paying taxes.

So, if you feel others are insensitive, take a look at your side of things and come to an understanding - it goes both ways.

I remember reading somewhere -- almost certainly within a link there -- that if a Mexican citizen seeks to emigrate from Mexico without all of his papers being in order in accordance with the laws of the country to which he seeks to emigrate, he is in violation of Mexican law. Holy mackerel, si man.

Ignoring any political biases that we may have will enable us to learn some interesting objective information from many (most) of the links in the article. For example, click the one called "examine Mexico's immigration policy" near the top (fourth one).

A lot of fodder for thought, si man... and how thought-provoking is the suggestion that the U.S. emulate Mexico's immigration policies, si man.

No need to discuss this too much here; it's presented to add some perspective to what has become a rather hot discussion between the OP and others. I may start a new thread and introduce the above article in the "General Immigration" forum, si man.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
