Hello,

I am brand new to this site and don't even know if I am posting correctly!!

Anyhoo, I am the Petitioner on my Mexican husbands behalf. I filed the I-130 in June 2009 and we received his Interview appt on November 27, 2009. We have one way tickets to El Paso leaving the 18th. His Interview is the 23rd. I have been told MANY different things and am soooo CONFUSED. I was told by some that as his Wife and Petetioner that I was required to go and now others have said that I do not. He has been here illegally since 1998 and we have been together since 2006. We have one child together and another on the way. My Husband doesn't feel comfortable traveling alone thru checkpoints and has no idea which papers are which in all our mounds of paperwork. I figured sending him alone would be like sending him to swim with sharks!! Can anyone give me any insight or help?? We are expecting him to have to stay behing in Mexico for up to a year or possibly more since he entered illegally, but does anyone really know from their personal experience? We have been told so many different things and have done everything on our own without a Lawyers help. Like what happens at the Interview? After the Interview? What is the waiver for? Does he need to make an appt for one, or do they tell him that in Juarez? I am just so worried and feel like we are entering the unknown...ANY help would be greatly appreciated..

I came to this website and posted this HOPING to connect with other people in SIMILAR situations such as mine. I did NOT expect people to pass judgement and post their opinions about Illegal Mexicans not having a right to be here because they broke the law. I asked for other peoples knowledge, answers from experiences and nothing else. Forgive me for having an attitude towards people who throw stones from glass houses and think their situation is high and mighty because they are doing something in a way that they THINK is the right or legal way. Not one of you knows how or why my Husband came to be in this Country, YOU all assumed that because he was ILLEGAL, that he came here that way. Judging us without knowing all the facts..but it's funny that everyone posting is from Countries where Immigration is COMPLETLY DIFFERENT. I agree laws should not be broken, and if they are there should obviously be consequences. However, I do believe that people should be given second chances and the right to make amends. And people forget that it's our own Immigrations laws and Government that let illegal passage happen every day. And if it were so easy for Mexicans or any others to obtain Visa's so easily and lawfully, don't you think more would have them and not cross illegally? I never came here for a "p1ssing match", but feel I have every right to defend myself and others I know. I came here seeking advice, not assumptions or judgments, but obviously I came to the wrong place. Thank you for those of you who did not judge and offered your opinions and thoughts. I wish you all the best of luck in your situations. And if there are people out there, like other Mexicans that have been thru a similar process, I would love to hear your stories. I was never looking for sympathy, so for one to assume that is ridiculous. Maybe my origional post should be re-read. I asked about the Juarez Interview and Waiver Interview process and if you aren't familiar with those, then I don't see why you are here posting comments. That would be why I'm not in another forum commenting on something I know nothing about.....

Only been illegal one decade......as if you are CHICA perfect and did everything in your life "the right way".....Question for you...Have you a clue how my husband came to this Country or better yet, why? Or have you walked a mile in his or my shoes to post a ###### brazen comment like that....How many Mexicans ARE legal in the US? I am not perfect by any means, but I sleep at night like a baby, having not one worry about my status in this country. I am legal and have always been legal.

I do not know -or care- how your husband -or anyone's husband- comes and remains here illegally for 11 years. All I care -and told you- is that it will be a very hard road for you both. And also that if gives people like me, Mexican citizens with nothing to hide, a terrible reputation thanks to folks who "cross over". So not one iota of sympathy.

And you might want to rethink the use of ANGRY CAPS, as it just causes much more hilarity and will only contribute to you becoming more alienated from the VJ members who can help you. You guys are in a sh1tty situation of your own making, so be angry at yourselves, not at anyone else.

Yes, why in fact, I am 12.... Good guess, and good for you for being legal and always being so, SO am I!! Like I said, you are perfect and had the perfect life unlike the other billions of illegal Mexicans who HAD to cross illegal for MANY reasons. Whatever reason anyone has for entering this country illegally is immaterial. It happened and that is all that USCIS will care about. Getting upset and insulting people who give you advice that isn't all rainbows and unicorns won't get you anywhere. You can keep looking for people who will validate, or you can get real and ask questions about the tough road ahead. There are plenty of people on this board who are very knowledgeable, but be forewarned, not all advice will be pleasant to your ears.

I never got upset with someone on here that offered me advice. I got upset with the ignorant people who posted on here to JUDGE. This got nobody anywhere. If there were such knowledgable people, such as yourself, why aren't there any posts with info about situations similar to mine??? And I am to be forewarned by YOU that nothing will be pleasant to my ears???? Hello??? One person on here Ms. B was the ONLY one that had any info about Juarez. Seriously, unless you have something that pertains to my origional post, why in heavens name would you waste your time posting on here?? Have you nothing better to do??? I don't need anything validated, thank you.

OP you're burning bridges w/ ppl that are trying to help you. And it sounds like you need all the help you can get. Alot of the ppl you have engaged with in arguing with are pretty knowlegable ppl you are marginalizing yourself from. You have entered a forum in which most if not all ppl here are trying to immigrate legally. The USCIS is not going to give out hugs to you, so think of this as "boot camp". Ppl come across harsh, and sometimes crass becasue this is the nature of the beast.

Think of it like this. You fall overboard on a boat, you are struggling to swim. Someone come's in the water to save you. Chances are the person saving you is gonna not going to exchange formalities and pleasantries. It's gonna be more like "Hey you! take the effin life jacket or you're gonna drown" type responce.

Thank you Chris, now how are you knowledgeable in my situation? Did my origional or any of my posts ask for *hugs*? And I'm burning what bridges?? seriously, this is all getting funnier and funnier by the post.

It's not that people don't know why people immigrate here illegally from Mexico, or whether or not in their minds they have a 'valid' reason, it's that it is a crime. Trust me, I know the situation for most in Mexico and it's not pretty but that doesn't justify breaking US laws IMO.

For example, the police will still arrest someone for stealing, even if it was to feed or clothe their family. Unfortunately breaking the law has consequences, for whatever reason (good bad or indifferent) it may be.

This will unfortunately create a difficult situation for you and your husband and you will need a waiver. There are many couples on this site who wish to immigrate the right way and undergo extreme hardship and separation through this process. There are others who have legitimate relationships and have their visas denied only to spend more and more money and time going through the process more than once.

Just as you wish for people to sympathize with you, the sympathy goes both ways.

Hope I shed some light on the subject

In the middle of a financial crisis where the local state and federal governments are in serious deficits, where we are cutting programs in our schools, where thousands and thousands are unemployed, illegal immigrants are working and living in the US and not paying taxes.

So, if you feel others are insensitive, take a look at your side of things and come to an understanding - it goes both ways.

Thank you, but please note that I never onced asked for anyone to sympathize with me. I was looking for others in a situation similar to mine that could offer info about their waiver process and interview. Nothing more, but I respect the fact everyone has an opinion, but I was brought up not to give mine unless it was asked for. And just a note, my Husband has paid taxes for the last 11 years, another ingnorant assumption to think he didn't pay taxes because of his status.....

I would advise you to stop antagonizing people here...that will only degenerate this thread into a flame war. Ignore those comments that are not to your liking and take the informative posts as your advice.

The fact of the matter is that your husband's entry without inspection (EWI) will be the most important factor at his visa interview. Not so much the illegal presence of 10 years. At the interview, your husband will be denied the visa because of the EWI, and BECAUSE of his 10 year illegal presence in the US, there will be an at least 10 year ban, meaning your husband cannot be the recipient of a US visa for that period of time. It will then be decided if the ban is waiver eligible or not. If it is... YOU, the US Citizen will need to present the circumstances which render you unable to move to your husband's country, i.e. document the hardship. If that is judged to have merit, a visa will be issued.

You have been advised to seek legal counsel....take that as very good advice, and consult with a qualified immigration attorney, that has experience with waivers and with situations such as yours. A competent attorney can give you a better idea of your chances for success given your situation. Good luck.

Ignorant assumption? :blink: Really? Well dear, I don't bring this up a lot (or ever) around VJ because I know how people feel about illegal immigrants in this country... but hey what the heck, I volunteered to advocate for illegal immigrants safety in my community while I was in my first 2 years of college. There were some hate crimes committed in my area and I had had enough of the violence & discrimination and decided to use my bilingual abilities for a good cause. I have friends who are/were illegal. One who hasn't been to her country since she was 2 years old but still doesn't have a greencard. So I gotcha. I'm far from ignorant.

And... I am not assuming anything. Illegal immigrants are often forced to use someone else's social security documents to work in this country which negatively affects the person who they have 'borrowed' it from. Working at the IRS, I can tell you this for a fact. However, MOST illegal immigrants do not steal social security numbers and they work off the books, which means they don't pay federal or state taxes.

Now if you're telling me that he was here in this country legally and then overstayed but continued to use the same SS# to work and pay taxes for 11 years without being caught, either he slipped through the IRS & INS cracks or thats complete BS. Most likely taxes were paid on someone else's documents or they weren't paid at all.

So sorry to disappoint you but I'm right. And although you want only people who have had the same experiences as you to respond, remember, you came to an open forum and unfortunately that's not possible.

why are you upset with people that have spent years studying the immigration process. you came on here for help, but the ones that know what they are doing, you get upset with. would you rather have them lie to you? or did you come here for truthful guidance? people cannot always tell the emotions when it is in a typed form. but it seems like you have taken things too seriously, and are trying to back up the fact that your husband came EWI. i have also worked as a volunteer with several people who have entered this country illegally as an ESL teacher.

if you are going to just get upset every time someone says something you don't agree with, then you are going to have an interesting life, to say the least.

Give Generously, Live Fully, Laugh Often, Love Completely...AND PRAY ALWAYS!!!

He is home!!!
