ok, new to this site. Have recently reconnected with the girl I truly love, lives In England, coming here in Febuary, havent seen each other in thirty years but know in our hearts we are to be together, willa K-1 work for us and how can she stay here with me for good. waited thiry years to marry this girl. I am currently going thru a divorce.

Before any type of fiancé or spousal visa can be filed - you must (both) be free to marry; in your case, your divorce must be final before you file. Can visit each other (in fact you're required to), learn about and prepare for the process in the mean time.

A good place to start (because at first it can seem a little overwhelming) is the What Visa Do We Need? section of the Guides. It will give you some simple comparisons of the different visas. To answer your question - a K-1 would work.

Do some reading in the Guides to see what the best option will be. You can begin prepping now, so you can file shortly after the divorce is final.

Also do some reading in the US regional forum for consulate specific information.

Having a har dtime deciphering your English. Do you mean your divorce will not be finalized until March, 2010? And do you mean that she will be visiting you before that?

I don't know if this will present a problem at the interview; you seeing her and agreeing to become married to her while you are still not officially divorced.

seeing his fiance before the divorce is finalized is not going to be a problem at the interview ,

since his divorce will be finalized before he files

i was seperated from my ex ( for 5 years ) when i met tony then started the divorce ,

as long as he has the final divorce degrea when he files I 129f

it wont be a problem at the interview

but my advice is go visit your fiance or for her to come see you it is needed to have met in person at least once when you file for k1

I highly doubt it would present a problem in London. Maybe in China or Viet Nam, but in most consulates, no. Document your visit, you will need it for the K-1 filing. Read the guides, it is good advice.

Probably not a problem for most Consulates including London but I do have a good friend whose K1 was delayed due to their only in person meeting prior to filing was before the Chinese fiancee's divorce was final. The visa was issued but it took an extra three months after the interview.

The circumstances the OP describes prompt me to strongly suggest he have at least an initial consultation with an immigration professional. He is likely to be glad he did.
