Petitioning the person after a couple of years? Is it possible?

I have a friend who went here on a K1 visa but was sent home by her fiance after only 12 days of stay here. Reason given to her was that he can't get along with her son from a previous relationship who btw, is barely 2 years old. The guy decided to put their wedding on hold because of the kid's inability to like him. I told my friend that his reasoning is totally absurd and thought that her fiance is just using her son as an excuse to get rid of her, but bottomline is he really is dumping her for good. Not to mention that the guy actually hit her kid on their 2nd day here for crying too much. Ridiculous!

Anyhow, she wants to know if she can be petitioned by the same person after 2 years and push through with their wedding plans? the guy actually told her that he will just wait until her kid is old enough to to like him.

Will appreciate your thoughts on this matter. Thanks!

If this girl has any sense, she will keep herself and her child away from your friend. He sounds like he has some anger problems.

What happens if he never likes her child? I cringe at the thought of what he would do to him.

As for petitioning, i am not sure, but im sure someone who knows will come along.

legally: don't see why it would be an issue, with regards to paperwork and all.

emotionally, and common-sense wise: WHY would she put herself through that....wait till he's old enough to "like him" and what if they had a kid together, would he act the same way? he sounds like a real winner, i think she should find someone else to spend her life with....tool.

I think that was a good sign, and it happened early for less, but not zero harm.

There is not a reason to return to this guy.

since she went home without marrying w/in 90 days, what she did (even though it was actually the fiance who caused it to happen) was abandonement of her obligation as a K1 visa holder, which means she has to undergo the whole process all over again (be petitioned by a fiance, apply for a visa etc) if she wants to come back

she can be petitioned by the same person, but since the guy doesn't like her son, do you think he'll go through the process again, not to mention the expenses? maybe, but then again wouldn't it be absurd on the part of your friend to even hope the guy who hit her son would petition her again?

the fact that the guy sent her home after 12 days means he didn't love her....or love her enough to love her son as well.

you need to tell her her fiance BSed her and continues toBS her with wedding promises

what she could've and shooul've done was report the incident to authorities. if she did, the guy might have a problem petition a fiancee in the future. if she didn't that makes her and her fiance two people who are unfit as a parent and unfit to be a parent.

WoW! He actually hit her child! Your friend should consider herself lucky that she went back home. You have already given her good advice but I would do everything I could to convince her that this guy has no place in her and especially her child's life. Truly sad.

Should be no problem. There is no need to wait that long if he hasn't petitioned for anyone else within that 2 year time period.

What an emotionally immature pig your friends fiance is. Doesn't get on with a 2 year old? My goodness. Is your friend sure he's "the one", I cant believe I would ever be in a position to forgive my fiance if those events had unfolded.

I honestly think that my friend lost her brain when she met this guy. Over the course of their one year relationship, they've only been with each other personally for 2 weeks. A week when he visited her in the Philippines and the 12 days that she was here in the US. Not sure how often they communicate through phone, email or chat because she would always tell me that he's a busy man. All I know is that the guy asked her to shoulder her kid's visa processing expenses, that he initially gave the kid a one month deadline (as soon as they arrived here) to adjust and like him and deliberately changing his mind and postponing their wedding plans to the point that her visa would have reach its end of life already. His infamous line is "Let's see if this will work" referring to their relationship as some sort of experiment when she thought that everything has already been decided.

I tried to talk her out of this mess even before she got here as I already had a hunch that this will happen but she still pushed through with her plans even though her instincts says it's wrong. I am just happy that they're already back home and safe. I believe that the 2 years of waiting promise that the guy gave is nonsense. I told her to use her brain and not consider going back here if it's with the same guy, but all she can tell me is that she loves him and still wants to marry him. The guy obviously didn't love her enough or rather, didn't love her at all and she should consider herself lucky that they were sent home before everything gets worst.

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

Maybe she should be considering her child's wants and needs before desperately marrying someone like that.
