So me and my fiance had our I 29 f approved and he had to go to the embassy for his interview in May of 2008. He went and they denied it, stating that that our realtionship wasnt bonifide...whatever... so they sent it back.. to USCIS for possible revocation.

So of course im fuming but I know that love will prevail and we will be together. Well it took the nigerain Embassy from may until January of 2009 to send the petition back..very frustratuing but again im patient because im sure it will all work out.

So our petition was sent back and recieved in Vermont in January of 2009 for possible revocation. It is August 16th and I have not head one word from Vermont. I have called many times to put in expedited requests, and my expedited request was denied. I have put in 2 service orders, and they send me a letter saying that they are working on it and sorry for the delay.

What the world can I do to make these people tell me what is going on. It has been 8 months, and its so hard to not know whats going on.

January 12 2008 : Sent I-129F to Vermont

January 24 2008 : NOA1 recieved in the mail

January 23 2008 : Touched

January 29 2008 : Touched again

January 30 2008 : Touched again

January 31 2008 : Touched again..

im not sure if I29f expires or not? I will research on how to get my congressman involved. As im reading these forums I see that I made a mistake by letting the petition get out of nigeria.

January 12 2008 : Sent I-129F to Vermont

January 15 2008 : Package arrived ok

January 24 2008 : NOA1 recieved in the mail

January 23 2008 : Touched

I think your attitude about this is amazing, I'm sure that if I was in the same shoes I would not be near so cool about it.

Here are my suggestions:

1)Consultation with a good lawyer to see what options you have court wise (although I think that would be costly and end up in a denial anyways).

2)Involving your congressmen and senator.

3)Getting married (abandoning the K-1) and filing for a CR-1.

Edit : Yes missed the previous post, it's very difficult to get an approval once a suggested revocation case has made it'd way back to the US.

Oh goodness that doesnt sound promising at all. Im thinking i should just wait it out, and all will be fine, but i m reading otherwise...how long does something like this usually take to get finalized?I feel uncomfrotable abadoning something i spent so much time on but if i will only get lost in nvc hell then i need to think of a new game plan.

Start by contacting your congressman and senator, then book a consultation with a good immigration lawyer. You don't need to necissarilly hire them but maybe just buy an hour so you can pick there brain a bit and see what their next course of action would be.

Think of it this way, it's been over a year since they suggested your petition be revoked, at this point you could have already had the CR1 in hand. Thats a crappy way to think of things but its the truth. :(

You send a letter to "WITHDRAW" the existing petition. Then you go to Nigeria again, get married and start over with a spouse visa process. This time be very prepared. Remove the word "whatever" from your vocabulary and focus on what needs to be done. If doing so is beyond your abilities, get professional assistance.

when my i-129f petition was sent back to the usa, i was told under no circumstances to withdraw. it is like admitting guilt when you did nothing wrong.

you have to find out why the embassy originally denied, and do everything possible to overcome, then you can refile. if they sent it back because of expiration, be careful, but vsc has a tendency to review and reaffirm lately. csc, let ours remain expired. it was sent back from india because we didn't have enough evidence proof. so after we got married, i filed the i-130 with over 11 pounds of evidence.

if you do decide to get married, your k1 is completely invalid. csc sent our letter stating our petition was expired and we could refile within 5 months of receiving. vsc has been known in the past to take years.

edited to say, i picked the brain of attorney marc ellis who is well-versed in returned petitions. i did not hire him, therefore, could only ask "general" questions. he is known on vj as ellis-island.

Write to withdraw your petition, certify and keep a copy for your records. Go to Nigeria and get married and refile for a CR1/K3 visa.

Go and get married and start a new petition. I did and it only took 4mos and 6days before everything was completed and him home with me. You will here people tell you about certain attorneys telling you to wait and rebuttle it. I didn't wait for USCIS to send me anything, I went and got married refiled, and sent in the proof of my marriage to Vermount so that they would cancel my I129f. I have no regrets because like I wrote earlier my husband is here with me. Thank GOD I did not listen to the one attorney I consultated with. Because if I did my husband would not be here with me right now.

Write to withdraw your petition, certify and keep a copy for your records. Go to Nigeria and get married and refile for a CR1/K3 visa.

Yes, but K3 is a bad choice, virtually obsolete. Stick with the CR1. In your withdrawal letter, simply indicate the reason for withdrawal is that you have decided to marry abroad and pursue a spouse visa. No other explanation is needed.

i agree with MENA, we didn't wait either, because like i said, i heard it takes years. we were told they received our petition on feb 4. i got married on may 12, sent our petition on june 29 (noa1) and on july 14, they cancelled our previous petition, sending the letter, but by that time, they already had our i130. cr1 is a better visa than k1 by all means anyways, so u can look at them as doing u a favor in the end.
