how do i send my wife back to vietnam

yeah but right now im not working i would like to find a job in wichita where i grew up but i think i need to go to vietnam and relax for a while. anyw3ays i was worried sick about my wife but i guess shes ok. booses wife just called and offered any money for lawyer for divorced or get her out of country if i need

You aren't working and you need financial help from "booses wife" for your divorce, yet, instead of looking for work, you are going to Vietnam to "relax." I don't suppose that "relax" is an euphemism for using prostitutes, is it?

Based on what you posted here and the other info about the gambling and $$$ I have to say...

1. focus on the divorce..

2. look at it as a bad experience and put it behind you..

3. Get an HIV test ASAP.

I'm not trying to be a #######, just a realist... we all make mistakes and she was your mistake.. let it go and enjoy the rest of your life... Imagine how much pain you would still be going through if you had not taken that step to part ways.. she's out making a mess of someone elses life now not yours....Things can only get better from here... Life is a mission... you got wounded in a battle but are not out of the fight.... you know what to avoid next time....

4th Aug - RFE for AP (via e-mail) documents lost!

what does she charge?? Just forget about her, don't get involved in any way with the boss's wife who is also angry, and get the divorce. With whatever information it has, the government will take care of getting her back to Viet Nam if they want to. Yes, and get the HIV test quickly.

I beg to Differ, YOU can do nothing of the sort as far as sending her back. Get over it and on with your life, let her see what she can and can not do with this situation. A conditional resident still has rights whether you like to hear it or not.

Karma works very well and can go both ways.......

From your time line she has been here a while, she can surely remove conditions on her own? You have know her for over 3 years and did not see the signs? Or maybe you thought she would change? How did you meet her? Was there a red light outside her front door?

Actually, he can do something - he can divorce her. The "condition" in her "conditional residency" is that she remain married to her sponsor for 2 years. Technically, her conditional residency is voided if they are divorced. "Remove conditions on her own" is a bit of a misnomer - what she can actually do is file an application for a waiver at the same time she files the I-751. The burden is then on her to prove she entered the marriage in good faith. Even that route would not be available to her if the divorce hasn't been granted yet. She'd have to wait until the removal proceedings to request a continuance.

Also, as I mentioned before, if he has evidence that he was duped for immigration purposes, then he can file for an annulment. If the annulment is granted, then her residency is revoked - no chance of appeal, no opportunity to remove conditions - she has to leave the country.

Finally, if she's convicted of prostitution then she can be deported, regardless of whether or not she's removed conditions.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

PS> In case you haven't figured out on your own yet, when you have to come to an online forum for consultation what to do with your marriage, may be you're not mature/ready to be married. You are a perfect example why certain people although are of legal age, yet should not be allowed to get married.

Just remember, life over there in VN is NOT real! Your money will be worth a LOT less once you get back over here. Back to reality, cowboy!
