Not sure if this belongs to this forum. My fiancee just entered the US on K1 visa a week ago and we are looking to do a civil marriage so I can file for her AOS as soon as possible. Looking at the marriage license requirement docs in my state, I see that among other things, a SSN/card is required. I was planning to apply for her SSN after the marriage with the new name.

What is the process I need to follow. Can someone point me to the right link. pls help.

thanks a bunch.

Check with the county clerk's office.

I know the NC Magistrate's website says SSN, but there is no requirement of being a citizen or LPR to getting married. I think the clerk's office can give you a better answer.

Apply for the SSN now in her maiden name.

Get married.

Go to SSN office and change name.

Exactly - and by 'check', you should pick up the phone and call your local office (usually the County Clerk's office) and find out exactly what is required vs what is listed on the web site.

In Texas - they list SSN as required but it actually isn't (if you don't have one). It's only required if you have one (as they would tell you over the telephone or in person).

As far as applying - it is as simple as payxibka described. Something to keep in mind - unless there is some driving reason you absolutely must have the SSN/card in the married name, most folks have a better experience when simply applying for the SSN under the same name as is in the passport.

Changing the name is a simple matter down the road - but it is up to you.

To add to what others have said, if you call and they tell you that you both need a SSN, ask if you can get a waiver. Where we were married, the website states that there is a 72hr waiting period and that both parties need a SSN. When I called, a lady explained that I could get all of that waived. It was easy, a judge had to waive it for us and it only took a few extra minutes. We also delivered the paperwork ourselves after our ceremony so that we could get certified copies the same day.

Get the SSN before the wedding in the maiden name. It is easier to change the name afterwards than to battle with the lack of knowledgeable workers rampant in many SSA offices who insist the name must be the same as is listed on the S.A.V.E. immigration system and won't accept the marriage certificate as a legal name change. This is one of those things to do sooner rather than later.

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”
