Hi everyone,

I'm getting out of the Navy soon and about to join the Naval Reserves. The job I want requires that all immediate family be US Citizens. My fiance should be here in June (we'll be married in June), and I am wondering what constitues his being a legal US Citizen? The adjustment of status? the Green Card? Is it possible that he would be legally considered a US Citizen by January of 2010?

An LPR (Green-card holder) is NOT a US Citizen, they are a Legal RESIDENT.

There is NO way for a person to become a US citizen in less than 3 years after becoming an LPR.

True, I know someone who is a high level position at a major defense contractor, and before that retired as a Captain in the Navy, I highly suspect he requires a very high clearance level to do his job. His wife is a recent immigrant, and LPR Edited by YuAndDan

Yes there are some federal job which require this. Particularly Military related jobs. Many many years ago my father was denied a certain job type because his father was from Nasau, Bahamas.....not a US citizen. It is for security reasons.

Marriage does not afford a person US citizenship until they qualify for naturalization. He would only be a legal permanent resident by 2010.

Not a chance. He has to be in the US married to you for 3 years and then can apply to become a citizen, a process that reuires more itme in itself. If he arrives this year, he may be able to become a citizen in 2013. He would most likely have his US permanent residency by January 2010.

Not a chance. He has to be in the US married to you for 3 years and then can apply to become a citizen, a process that reuires more itme in itself. If he arrives this year, he may be able to become a citizen in 2013. He would most likely have his US permanent residency by January 2010.

Just to add has to be LPR in the US for 3 years while continuously residing with ame married to a US citizen for those 3 years.

Only way to be LPR upon entry to the USA is to enter the USA on an immigrant visa like CR-1 or IR-1. K-Visas wont have LPR status until after AOS is approved, which can be months to years after filing an I-485.

I can tell you that at the end of 2008 they passed a new regulation for clearances stating that the U.S. spouse condition can be waived. I have a copy of the legislation somewhere and will try to find it for you. Perhaps you could wave that under their noses and ask for a waiver for your honey. :)

I was a CTI in the Navy and YES it is the BEST career you can have in the Navy. You will be totally spoiled. :P

Dude!! What are the odds, right?? hahaha.. wow, that's awesome! Thanks a BUNCH, and I'll take anything you can give me! Even if I have to wait 3 years until Omar becomes a USC, I would still do it.. but it makes it soooo much more convenient to do it now (ie going to school and staying relatively "active" while that happens instead of getting out of active and then coming back in in 3 years)... THANKS PANDY JAN!!! :D;)

It's at work and I won't be there until Wednesday. I'll look for it then! YW. I hope it works for you! Have you taken the DLAB? You have to have certain scores to be able to take the more difficult languages. If you have a high score they will definitely think about the waiver because the main reason they created the waiver was because of a shortage of linguists in certain areas. ;-)

And what about : He arrives in the USA, you wait to get married. You applied for you job, he is not yet a part of your immediate family. You get the job and THEN you get married ?

I read somewhere that this is 3 years after your wedding date and not after your approval. Some people asked for naturalization before to get the green card cuz' it took forever to get approved.

If you are at least 18 years old and:

Are currently married to and living with a U.S. citizen;

and

Have been married to and living with that same U.S.

citizen for the past 3 years;

and

Your spouse has been a U.S. citizen for the past 3 years

3 years as a Permanent Resident without leaving the

United States for trips of 6 months or longer.

----

So it seems that the spouse has to have been a PR for 3 years as well as having had been married to the US citizen for those three years. That's what it looks like to me. So even if you had been married for ten years before your spouse came to the US and got the PR, they would still have to wait three years from getting the PR to apply for citizenship.

This is really funny. You have an Afghani fiancee and want to take a security clearance job in the navy. Yeah, good luck with that.
