RFE for including too much info!!

can we get RFE if my I 864 only contains the last 3 yrs ( 2005-2007) since I have not filed my taxes yet and do not intend to do so until last minute since I owe on my taxes this year? Can NVC say oh we can't complete the case until u send us the 2008 tax return?

I am starting to worry, and confuse myself now. I turned in my I-864 for 2008, and I also including W2, and 1040 for all 3 years, 06, 07, and 08 ( All copy of my taxes return). Since my sister is the one file taxes for me every year. BUT, I haven't recieve the money from the IRS ( FED, & States Tax). Am I Okay?

I think you should be fine. Her RFE was caused because she submitted tax returns for 2005, 2006 and 2007 and added her sponsor's W2 for 2008 (when she had not filed/included her 2008 return). So like queeudup said, it raised a red flag with NVC asking where is her 2008 return. It sucks I know :angry: but that is what happened with Mkg. Does that make sense?

I called NVC and asked if submitting the 2005. 2006, 2007 could result in an RFE from them asking where is the 2008 tax return and the rep told me not unless the AOS (I864) was submitted past the IRS April 15th deadline. When in doubt call and ask an NVC rep. :thumbs:

While i'm sorry the OP got an RFE, you can kind of understand why they are sending it back - if you submit 'part' of a years tax information but not the rest - then it seems understandable that they would say hey - where is the rest of this tax return.

I think people should be careful with sending too much information - more - in this case - is not always better. Focus on sending correct forms and correct documents and not overloading the envelope with things not asked for. Try to look at it from the view of the person working at NVC.

For those in this thread that had questions about which year(s) return to send, at this point - it would be 2007 or 05, 06, 07 if you are sending 3 years:

Example 1 : Sponsor signs the Form I-864 on March 1, 2006. The US Federal income tax return for 2005 is not due until April 17, 2006. Therefore, the sponsor must submit his or her 2004 U.S. Federal income tax return.

Example 2 : Sponsor signs the Form I-864 on May 5, 2006. The sponsor must submit his or her 2005 U.S. Federal income tax return.

Example 3 : Sponsor signs the Form I-864 on May 5, 2006. However, the sponsor also filed with IRS a Form 4868, obtaining an extension of the 2005 income tax filing deadline. The sponsor must submit his or her 2004 U.S. Federal income tax return. link

I included my 2008 IRS tax returns and my husband's tax returns and also te 2007 tax returns for both of us, but i also sent copies of the W2s for each year, i hope they dont give us an RFE, i wanted to send the most info possible so that they wouldnt give us problems. this sucks, i feel like i cant win.

no, my husband has been here for the last 3 years off and on an an h2b workers visa, thats how we met, and he has filed taxes because he works here in the U.S with the visa, i included is information, since i am sponsoring him and he is the intending immigrant, it allows you to show proof that the intending immigrant maybe able to support themselves, or has their own assets and stuff, thats why they included that extra space on the form as far as i know.

Sorry this happened, but you didn't follow the instructions, your only suppose to include W-2's if you include the tax returns (photocopies) they are related to.

They can't throw away your W-2's since is a privacy thing.

You could of avoided this whole thing and just provide the tax transcripts. Then you don't have do not have to send W-2's.

No - you shouldn't, according to the instructions....

You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

If you included the tax returns that go with the w-2's, your good to go, the op's problem was that they sent w-2's without the corresponding tax returns.

If you provide a photocopy of your tax return(s), you must include a copy of each and every Form W-2 and Form 1099that relates to your return(s). Do not include copies of these Forms if you provide an IRS transcript of your return(s) rather than a photocopy.

Doesn't anyone read the instructions for the forms??? :blink:

I just got off the phone with NVC and I got an RFE on my AOS packet because I included my sponsor's 2008 W-2s.

I-864 is filled out for 2007 and I included sponsor's 2007 taxes and sponsor's 2007 W-2s. Since the deadline is coming up I included the sponsor's 2008 w-2s for an extra measure. The woman on the phone basically told me to send the whole package again just without the 2008 W-2s.

I'm I retarded or are they?

Do I have to wait for the RFE in the mail or can I send the package again or send at email?

hmmm.. strange.. my husband did exactly the same but we didnt get an RFE..

05-01-2008 - NOA2 approved!

05-09-2008 - Recieved hard copy of NOA2
