my gf(usa citizen) is pregnant and I'm(foregin) the dad, what kind of visa should I get to immigration and live with her while she is preggy and what kinda should i get after she have the baby???

and does it help more if she was my fiance instead of being jus gf??

If you want to wait until you get to the U.S. to get married, then file for the K-1, if you want to get married before you get here, then file for the CR1. Your girlfriend would be the one to do all of filing, not you. If you look at the very top of the page, you will see the menu in big white letters. Just click on the one that says "Guides".

the baby doesn't need any VISA, because your girlfriend is a United States Citizen the baby will be one as well, you'll just need to decide which route you want to go with your immigration process...

lol, who told you this, the baby has nothing to do with your immigration process.. you will still need to go through the proper channels to immigrate...

Whatever your aunt's 3rd cousins neighbor told you is WRONG! THere is so much misinformation from well intentioned individuals about immigration. Some are repeating info that was correct 20 years ago, some for info for people in different cases and some just make stuff up. Not sure if your country participates in the GC lottery, but if so, that is one option if you dont want to marry your gf right now. If you are ready to make the commitment, you can file for a K1 for a fiance visa, wait, get approved, move here and get married. OR you can file for a K3 or CR1 if you wish to marry now. The baby will have no impact on your visa, except it will prove you saw each other within the last 2 years (a requirement for the K1). Regardless, you are looking at a long wait and most likely will not be here for the pregnancy unless you have a tourist visa and can come visit (note this is a visit, and you can't use it to marry and file for your GC since you have immigrant intent). For many people this is a 9 month + process.

As the others have said, the baby won't help you immigrate. If you want to immigrate and be with her for the birth, file a K1 (fiance visa) very soon, as the visa process can easily take 8 months, often more, especially for males from Arabic countries; K3/ CR1 is also an option, that is the spousal visa, but you'd need to be married first of course so that would delay filing. Your other option is to try for a tourist visa so you can be with her for the birth, but having a US fiancee/ gf who is pregnant will make getting a tourist visa difficult.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

as most said the baby will not make a difference in the way you enter USA and i would count on about a year if all goes well, hope she is set up to do all this alone with work and money until you get here

You heard wrong. The baby and your girlfriend have absolutley nothing to do with your immigration status. Read the guides and determine which route you would like to choose to immigrate to the USA and marry your girlfriend or marry her first, in your country, and then immigrate to be with your wife. This will not make you a citizen of the USA. That is a separate process.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I have nothing to add regarding the OP's question about his own visa options - that's been answered correctly many times here already.

I just wanted to jump in on this one point about the baby.

The baby *most probably* will be born a US citizen due to the mother being a USC.

However that's not necessarily so.

- If the baby will be born in the US - he/she will be a USC from birth.

- If the baby is born outside the US - he/she will be a USC from birth assuming the mother met the residency requirements throughout her life.

- If the baby is born outside the US and the mother did NOT meet the residency requirements, the baby may not be born a USC. It would then be determined by whether the grandparents - the mother's parents - met the residency requirements.

I point all this out because we know nothing of the mother's US status or intentions, from the OP's post.

This may make a difference in their plans, too. For example, if they decide that due to how long it wil take to complete K1/K3 filing that the OP's fiancee should travel to his country and stay with him there for the baby's birth, this could have an impact on the baby's US status.
