What about CR1.. do we get 10gc or conditional GC if we have not passed 2 years after wedding???

I know the reps at USCIS don't know anything. but I just thought it was odd that she would say that to me. My attorney told me that the K-3 will get to the embassy faster. So I proceed with the K-3 and then what.... instead of a conditional GC he gets his Permanent GC??? I should have listened in class, huh?

If you have been married for over 2 Yrs you qualify for a 10 GC

If your are married less that two year you will get the conditional GC but if you have 2 or more you will get the 10 years GC. By the way this time is at the interview. So for example your interview is on April 10, 2009 and you get married on april 11, 2007 you will get the conditional green card but if you have more than two years at the interview you will get the 10 years one.

Timeline

It depends on when you enter the US. lets say you get your visa 1 month before your 2 year wedding anniversary. And then you enter 15 days after your 2 year wedding anniversary, you qualify for the 10 year GC, if you enter 15 days before the 2 year wedding anniversary you get the conditional GC.

Why the K-3 over CR-1? And do you really want to apply for Adjustment of Status once you get to the US, and deal with VSC, and potentially do another interview. Plus its another $1010 dollars.

Well, in that case your hubby will need to do the Adjust of Status when he come to US. This process will add a few more months to all this process and don't know if you knew this but you will need to go through the USCIS AGAIN!!!!, so by the time he get the in-country interview for the AOS you may be at the two years limit and he may get the 10 years GC.

Can I ask why are you following the K-3 process?

K3 for us too ... a lot faster with a lot less hassles up front. I mean, how many people have you seen, even here, that go CR1 and then get stuck at the NVC for months? I know there are "short cuts" that can speed things up, but you see a lot of people hit a snag for some stupid reason or another and *bam*, they are still waiting 4, 5, or 6 more months. And you have more $$$ to pay right away for a CR1. And that figure really adds up when you add children.

Things are too tight right now financially and with this economy, I'd rather have her here a.s.a.p. then go through the extra months the CR1 'could' take. I mean, what if things get worse and you can't get your loved ones here? Things are working out for my trip over for the interview now. It will be 6 months since I have held my wife by the time the interview gets here ... for us ... we don't want to wait anymore.

Even with the immediate GC with the CR1, getting my wife & step-daughter home faster and cheaper "up front" made it an easy choice for us. We have two years to worry about adjusting. By then she will be working too, adding to the family income making the extra fees to adjust easier to manage.

I perfectly understand anyone who goes with either visa ... but especially those who have been waiting through the VSC for 250+ days ... my reaction would be a no-brainer ... K3 ... it's faster.

I was reading that the average number of days from the NVC receiving the package to the interview is 15 days for a K-3 in Costa Rica

I have a pit in my stomach... There is so much I need to do. The attorney is taking care of all the paperwork so I don't need to worry about any of that...

I noticed that most ppl get to their interview date usually 1-2 mons after NOA2. Fine by me as long as my husband is here by May (my birthday month) and above all I want him here for our first yr anniversary. It would be way tooooooo depressing to celebrate our anniversary on separate continents! Some ppl said they are 5 hrs, 4 hrs away by car or by plane! I wish we had that option. I would have visited every chance I got. Talk about a 14 hr flight difference b/w me and him :crying: That's why we decided to go the K3 route as well. I definitely don't want to be stuck in NVCH (H for hell) after being in VSCH for 230 days!!! :angry:

btw ... Ksenia and Sasha had their medical in Kiev today. Everything looks good ... :thumbs:

In Ukraine, you don't even need to wait for the packet. As long as you have a case number, you can do your medical right away. I found out about our approval from the NVC, not the CSC, with a letter that had our case number and telling us that our paperwork would be in Kiev within a week :)

Oct 20, 2008 - Checks cashed by USCIS

Oct 24, 2008 - NOA1 (I-130)

Oct 25, 2008 - I-129F Sent to CSC

Oct 29, 2008 - I-129F Received at CSC

Oct 30, 2008 - NOA1 for I-129F mailed to me - received 11/22/08 because of address change

Oct 31, 2008 - I-130 Touched

Nov 3, 2008 - I-130 Touched

Nov 18, 2008 - I-129F Touched

Nov 20, 2008 - I-130 (for step daughter) Touched

Feb 17, 2009 - Case received by the NVC

Feb 25, 2009 - Received letter from NVC dated Feb 20th saying they had received my approved I-129F

Feb 27, 2009 - Received 2 letters from NVC dated Feb 20th - they had received both approved I-130's

Mar 6, 2009 - Medical for Ksenia & Sasha completed in Kiev. Everything is great.

Mar 9, 2009 - Called NVC and found out our K3 is in "administrative processing"

Apr 6, 2009 - OUT OF A.P. !!! File being sent to Kiev !

May 5, 2009 - K3 interview in Kiev! APPROVED !!!

July 12, 2009 - ARRIVAL IN USA !!!
