K-3 Approvals With Dates After Ours?...

We are still currently waiting for our approval on both I-130 and I-129F, but we are seeing people here with later NOA1 dates than ours that are being approved.... what does this mean? They are with the same office as we are.... Vermont, and also working with the K-3. USCIS is still showing that they are working on March 07, 2008 and are long overdue with the processing times update. Does anyone know if they go by the dates of the receipt number, country or what? I am at a loss and we have been waiting so long to hear any news of an update or a touch, etc. Of course when we call, they can't tell us anything until they pass our date, but they won't update the date so we know where they currently are... our I-129F date is March 17, 2008 and I believe that is the date they go by. Is this a correct assumption and why are people with later dates being approved ahead of us without us hearing anything at all?

I would like to know that as well, looking at others approval, seems like they are going with I-130 dates. My I130 is feb 26th and 129f april 10 and everytime I call, pending is all i get. ):

No, they don´t follow the dates very strictly. My I-130 NOA1 is of MArch 26 and I´m still waiting while some people from APril have been approved. Of course there is a trend... Usually everybody from around the same dates get approved around the same time, but it´s not a rule. They say each case has its own characteristics which may take more time or less time to be approved. I dont know the characteristics though. I wish I knew them... Actually nobody knows what really happens inside VSC and CSC.

I hope we´re all approved soon! Good luck!

I hear you; I was also saying the same thing because people were getting approval even though my NOA1 was earlier than them. I got my NOA2 for both I130 and I129f on 12/29/08. I was an April filer. It took them exactly 8 months and 22 days for I130 NOA2. I guess VSC has its own way of working the files which is a mystery to all of us all. Good Luck and hung in there.

I believe that they work strictly in sequence (of I-130 NOA1 date) when it comes to assigning your case to the immigration officer adjudicating it. However different officers tend to have different workloads and priorities and of course some are more efficient than others. It could be that your file is with someone on a vacation or something whereas another officer has been rapidly approving the cases assigned to them. In any case you are already overdue for approval and it should be a matter of weeks if not days before you get approved.

If you are outside of the processing times, you need to call and request an expidite on your File. It wouldn't hurt to contact your Senator / Congreessman and have them inquire into the status of your application.

VSC seems to be picking up the momentum and approving Feb/March files...Good Luck
