I found out they want the details of how my friend and my fiancee's brother met and how they set us up. Before my friend told me they met over 10 years ago at a birthday party in las vegas. Durning the interview when they asked Tran specifics she did not know she had to call her brother and ask. Last night I pressured my friend into telling me the trueth and he told me they were gambling buddies. I know gambling is legal but I think it would hurt our case even if they have other stuff in common.

I was told to marry and not to cancel the denied visa even if it expires however I was also told you had to cancel it to start a new visa because if you have 2 in the system it will cause a problem so im not sure how that works.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Yeah that might work I was just worried they might think to bring her over here was part of a gambling debt. I think the best thing after reading the time it takes is just to go threw with the appeal and rebuttle. I do see it is taking on average of 2 years to appeal and since my case is already at the california service center it might take less time than that. If I marry her it wont be until april or may then we have to file IMBRA waver that will take 2 months then 11 months from there she would have her interview. So we would only save a few months at best and it would cost allot more to marry her and I don't think one would give us an advantage over the other one as long as we can succesfully rebuttle there disputes.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

We were denied a K1 as not a bonafide relationship they think it was a scam. I had a consult done with a lawyer they had stated that I had to prove how we met. Her brother and my friend are friends. They want to know how they are friends it turns out they are gambling buddys. I didn't know this neither did my fiancee and we are caught in the middle of this. If they sign an affidavid of how they met that coudl be detrimental to our case. The lawyer also stated now here is where I get confused." under no circumstances to withdraw my denied petition because my fiancee would be inadmissible for life from coming to the US but also stated I must cancle my denied petition to file for a K3" after I marry her.

Even if you have to cancel that petition it still on their system, they have record and they will check it when you refile petition. IF USCIS send you notice to let you know it expires you can refile petition, but if they send notice that your case is being review you should rebut what Consulate denied your visa. The old petition will get touch each time USCIS work on new petition.

her brother? your brother? your friend her friend? their relationships are not the factor but under what circumstances did you two meet, if thru these other people oh well you cant control what they do but tell them YOUR story of meeting. You say k1 denied, was it returned to calif? if so it will prob be allowed to expire on its own, then you can refile or marry whatever. If vermont they seem to hold forever to sometimes actually open them again and restart. Best thing is to just always tell the truth...(also i was told in calif a return to expire is not a deny but just that an expire)

07/25/08 NOA-1 FINALLY!!!!

07/31/08 CHECK WAS CASHED!

07/28/08 touched!!

12/08/08 NOA2 FINALLY!

12/13/08 NOA2 received in the mail

12/18/08 Called NVC at (603)334-0700 and talked to a nice lady named Rose. Our case was received on the13th and was sent out to sydney...WE WILL SEE!

12/13/08 NVC received letter and said they sent out to Sydney

12/18/08 received letter in the mail from NVC.

12/19/08 another letter from NVC stating it was shipped out

12/24/08 ARRIVED IN SYDNEY at 10:26 am and signed by tom

12/29/08 CONFIRMED it is at Sydney and Good ol Tom did sign for it LOL THANKS TOM!!

12/29/08 Sydney waiting for paper file from nvc and has it requested

12/31/08 Sydney confirmed through email that the paper file was received

01/05/09 His police checks are done and sent off!!

01/28/09 Kai went to his medicals forgot one of his passport pics and needs two more shots all was good!

2/18/09 medicals ready to be picked

2/20/09 packet 3 sent in

2/26/09 pkt 3 received today takes UP to 10 days

04/07/09 interview....APPROVED!!!!

04/20/09 He flew in ..flight was changed he was 3 hours late BUT HE IS HOME

port of entry took 2 mins!! LOL

04/25/09 WE ARE MARRIED!!!!!!!!!!
