WTH is going on...

I've been with my partner for 6 years. We got married in 2006; I received my conditional GC in May 2008. I go to Canada for a friends wedding in August 2008, I come back, and she wants to separate and get a divorce! I JUST GOT MY GREENCARD IN MAY! So, I'm utterly confused. She says she's unhappy. She doesn't want to work it out.

I'm really freakin' nervous about what's going to happen next. And of course, our marriage is as bona fide as you can get as we share leases, bank accounts and file taxes together. Has anyone had experiences like this before?

Mind you, she's the one wanting to divorce. This hit me like a mack truck. She's the USC, I'm the beneficiary.

I'm so freagin' confused and a bit nervous.

It's a tough situation. You haven't asked a question but most who come here in similar circumstances eventually ask about how to stay in the US. If there's a divorce, once it's final, you self petition to remove conditions. If you already have the ten year green card then no problem.

Sounds like you're getting a divorce. Get a good lawyer - and try not to be nasty about it. The nastier it gets, the more expensive it gets. Just make it quick, clean and get it over with as fast as you can.

Why not try to work it out? Or at least get some straight answers. There's more to worry about here than just staying legal in the US (although I know this is an immigration forum).

People don't just wake up one day and realize that they want a divorce. Obviously, this has been going on under the surface for a while. Good luck.

I agree, this must have been brewing for a while.

I also think that people who agree on marrying a person from a different country and bring them to the US to start a completely new life owe their spouses a little more effort than just saying "I'm unhappy, you need to get out".

I would want to know exactly why she is unhappy and if there really isn't a chance to get it straightened out.

ask her to get some counseling with you. if she won't, let her file the paper. then agree to pay half the costs and split amicably, if you can.

WOW!! What heartbreak!

But, just one thing to consider... after attempts on a resolution to your marriage, etc, and if your USC spouse is still intent on a divorce, you may want to consider that you ARE NOT the "petitioner" in filing for a divorce. The Petitioner is the party who is seeking the divorce, and is who files the paperwork accordingly.

My first concern would be that if you are actually the Petitioner of a divorce, then it appears that you are guilty of marrying a USC just to get that GC, conditional or otherwise, and it would likely go against you if your (possible) divorce ever becomes an issue in the future.

That's just my take on it. Protect yourself as best you can as it hurts enough already. Best wishes to you.

There is no reason to automatically assume he did anything wrong. For all he knows - she could have met someone else and she's making up the unhappy story to cover. Good marriages are suppposed to be based on communication - and if she had specific complaints about things that were making her unhappy - it's her responsibillity to bring them up.

Do your best to find out what's really going on and go from there.

Thank you for your well wishes and great responses. Some people here suggest that it was an underlying, brewing problem. And yes, that is certainly true. I've asked her to work it out, and the reason is she's divorcing is "...I'm not happy anymore. Our dynamic has changed, and I don't think we can fix it."

Trust me, I've tried everything. She does ensure me that she still "loves" me, but doesn't think we're right for each other. She said she will do whatever she needs with respect to the immigration issue.

We've been living together for 6-years, and after our marriage in 2006, things were just stressful: immigration process, etc.

Here's My Question;

Has anyone gone through something like this and still get their 10 year GC? I made it VERY clear to her, that I didn't want this divorce.

If your US citizen spouse believes that the marriage is/was legitimate, have her help you to compile sufficient evidences of your commingled social and financial lives so that you can submit a self-petition (I-751) upon recept of the divorce decree. An affidavit from her as to the bonafide nature of the marriage can also accompany your waiver.

Look into removal conditions forum for documents you will needed for I-751. Get all documents right now and affidevit from wife and friends and her family (pictures for 6 years, financial docs for 6 years, etc). You should send I-751 with waiver from dual signatures as soon as divorce is finalized. You should not wait for 2 years anniversary. Many people got approved without any problem-some even without interviews.
