hello everyone, i hope someone can give me some help regarding what the fastest way to process the K1 visa. (i imagine that everyone wants the fastest time with the least headache, but i just have to ask)

ok, i leave here in the states (philadelphia) and my fiance lives in Colombia (maybe not the best country for fast visa approvals). but i want to know how long it would take to do that whole K1 visa process and have her here with me in the USA. I've heard different things, so im kinda confused.....

1.....that it takes a year......

2.....that it could take about 6 months.....

3.....with a lawyer it could be less time....

4.....with X lawyer (recomended by my cousin) would take only 3 months.....

So what am i really looking at? if it takes only 3 months with X lawyer, i think its the best way, but i really dont know, i havnt talked to my cousin much and dont know where the lawyer is located....obviously its an extra charge but im willing to pay it....

i know its kinda a pain in the neck to do the processing yourself, which i know with the help here on visajourney and the step by step guidelines it would be easy, but i kinda want some help so i dont have to suffer from those headaches and filling everything out.....so i am willing to get a lawyer to help me out and do the processing and best of all if he knows a way to get the forms in faster and faster approvals for interniew and everything.....

Please what is my best option and what should i expect? What should i prepare for?

I've heard a lot of bad stories with lawyers, so I did the whole K1 by myself and we just got our application approved, it took 4 months. Now we are waiting for the interview which should be in a month or so. I think you are more than capable of doing it yourself, but if you want to get a lawyer you can.

I don't think it guarantees you a faster processing time. The applications are all processed as they are received.

lawyers will tell you what you waqnt to hear the process unfortunately takes as long as it takes i have seen 3 months i have seen a year he is human to rememberthere are so many factors that can go into the timeline that for anyone to tell you 3 months garenteed they are lieing that said i can understand having someone else deal with the head ache of the paperwork so by all means hire him if he gets her here in 3 months great but be prepared to wait at least six months maybe more i do wish you luck

There is no "fast" way .....with or without a lawyer....whatever its all the same....you are at the mercy of the system....just make sure you have

all your papers in order and you have met your fiance' in person within the last 2 years.......

Turning to a lawyer can only delay the process, and you lose control over the process. The petition for a K-1 can take 3-4 months, no matter whether you submit it, or the lawyer does. Then wait a month for our Embassy in Bogota to act. Predictably, it will then take 2-3 months for the interview and hopefully approval.

thanks for the help and the input as of now, im still not sure which is best because she also has a daughter (11 yrs old). I know she qualifies for the K2 visa and i read that i would have to put her in the I-129 form, but what other complications would i have to deal with that, i know it would have to be more work and complications. i know that they wont be able to travel together, but from what i read 6 months up to a year, which is fine, but is that another reason to have a lawyer expert in immigration visas......

i also heard this, but i dont think its true, and doesnt refer to me because im still looking for a job......

i remember now that a friend of mine used to work in a marrige agency in Cali, Colombia and she said that that happened once that they were travelling in 3 months on a K1 visa.....i dont know just thought to throw that comment in there......

I still am not working, i just arrived from living in Colombia with my fiance about a month ago, we lived with eachother for 1 year there so i know we wont have a problem in the proof of relationship, plenty of pictures, letters, and emails...... but i still am not working, i know that these forms cost money, but i do side jobs of paint work that gives me cash but not taxed so techincally in not working a normal fulltime job which im looking for..... i know after the I-129 form is sent, i have to send out another form ( i forget the number....325?) i forget but with that form i would need to send out my last 4 paysubs......so then i should and have to really wait to be able to start the whole process until i start working? and do they look at how much i make, is that an issue or a possible issue that they look at, the income of a person, that would be 'supporting a wife and child'? i mean im looking for an entry level position that would make no more than 35k to 40k a year. i dont think that would ever be a problem, the income, but i mean it seems pretty tough now looking for a well paying job and it might be even a lower income, maybe even in the high 20,000's (which isnt the best working and supporting a family), so should i have to worry about that? I mean im thinking alot in advance but i want to make the right decision and ask all the questions.....again thanks for the help....

Sorry, whoever told you that BS about "if you have money, a good lawyer can get it done in 3 months" is an idiot and obviously has NO clue what they are even talking about.

If you really think about it, how would a lawyer get it done faster? He can't tell the USCIS to "process this person's case faster because they paid more money for our law service". Absolutely not.

The process is a long and grueling process, no matter if you get a lawyer or not.

People will advise you to "get a lawyer", or "don't get a lawyer" but the decision ultimately ends with you. It's up to you. Some have had bad experiences with lawyers, while others good experiences.

But once again, no lawyer can process it faster for you. They can hurry up on organizing and sending out the respective packets, but other than that they have no say whatsoever in telling the embassy to process your particular case faster.

Another thing Omar; read the guides before posting these long questions, because about your questions regarding finances, what forms to fill out, etc., if you read the guides they will answer these questions for you.

I guess, you don't need a lawyer to solve your case..you are in the right place (VISa Journey) this site is really very informative..just take the advises of members and read a lot of information and experience and you will be fine with your journey.

In general, I think 6 months is a good estimate of how long it takes. A lawyer absolutely CANNOT make it go faster. Here is what they do...they refer to the useless information given by the USCIS as to "timelines" which always refer to the OLDEST case being handled, usually one with problems or one that has been dropped but they have not been notified. Then point to cases they have handled which went faster. It is a scam. There is NO ONE that can make this go faster than YOU. Get all your documents ready, file the case ASAP and then download package 3 from the embassy and get all those documents ready so when you get your NOA2 and the consulate gets your petition you can make your interview date right away. Check my timeline. I filed on March 19 and she COULD have had an interview on June 23, just over 3 months! BUT my fiancee could not make that date and the next available date was August 7 and she will be arriving Sept. 11 (again because of personal matters she had to wrap up before coming) and we will be married Sept. 19. 6 months exactly from when we filed. It could have been July 19th if it weren't for our own personal commitments that postponed things a bit.

DO NOT use an attorney, it is a complete waste of money. If you can follow the simple instructions, you will have no problem. The members here can give you better and faster responses to your questions. They were a great help to me.

lawyer does not mean it will be three months look at my time line we have a lawyer lol

in reality no one can tell u how short or how long ur k1 visa will take

some are very lucky and it is fast others take forever with no apparent reason its anybodys guess how long it can take but dont let someone tell u an attorney is faster...........

Take your time and do the forms yourself. The guides answer pretty much everything and people here will help you if you get stuck. The fact that you lived together should help your case. but as others have said, the case takes as long as it takes. Prepare for 6months to a year and if you get it sooner, so much the better. good luck.

Instead of asking, just file your K1 visa. The waiting begins once you file your K1 visa and normally it takes about 6 months until you hear some real movement about your case. Lately its been taking bout less than 1 year to get the visa. Dont hire a lawyer unless you want to waste your money... Just follow the guidelines in VJ and you'll be fine..

Before you file, make sure you have enough evidence that you and your fiance have met, photos together and establishment that its a bonafide relationship. Other than that, you worry next about sponsorship. If you work and can produce requirements that you make at least $17500 a year (for two people), using tax records and/or , paystubs for the past year or you have someone who can sponsor you than you are more than 99.99% guaranteed for the visa.

The fastest way to a K1 visa is submit the application yourself and make it complete and perfect by reading the guides, the FAQ, sample forms, suggestions on assembling the packet, etc. Have somebody proofread it for you. Enclose the correct fee.

Then while you're waiting on that approval, start preparing for the foreign Embassy stage. Read the Embassy Info and Reviews:Embassy in the menu bar above. Get police certifcates and tax forms ordered. Don't wait until your case is at the Embassy to figure out what comes next. Have every document in hand already so you can do a one day turn around.

About the times you mentioned in your original post...all are probably correct with or without a lawyer. The times change. They also change depending on if you file at California Service Center or Vermont.

People filing a month before me in Vermont were getting the first (USCIS) approval in 30 days. Mine took 50. Filing a month after that took 90-100 days in Vermont and longer in California.

You need to look at multiple time estimates.

1. How long to get the NOA1 receipt.

2. How long to from NOA1 to NOA2.

3. How long to get to NVC and then to Embassy.

A lawyer does not get preferred service to skip ahead of others.

There is no "fastest way"

There is one way, file and wait like everyone else.

Some people's K1 journey's are shorter, 5 to 6 months....some are longer, 10 to 12+ months. It all depends on your case, your background, the evidence you submit, etc. etc.

Each case is individual.

Ours took 7 months from filing to visa in hand.

Others I know here at VJ waited 7 months just for an approval and then went on waiting for the interview portion of the process which that waiting time varies from consulate to consulate.

If you feel confident that you can file on your own (which I'd say the majority of people here on VJ have), read up the Guides here on VJ, stay organized and file yourselves.

Lawyers are crazy expensive and unless you have a very complicated case, I think delay the process. Everything has to go through them before it gets to you and if you have a straight forward case, this just adds unneeded time onto your entire journey with a very high price tag.

What she said. I paid a lawyer $1,000 to do this K1 thing, and all I got for that was someone filling in the forms for me!! In my defence, I didn't know about VJ when I filed, because if I had, there's no way I would have used a lawyer.

And LOL @ your cousin's lawyer saying he can get it done in 3 months!!!! :lol:
