K-1 Visa Travel Question

hey all, im still waiting around for my NOA2 but i have a question, as i understand when my fiance receives her K-1 Visa it will be valid for a couple of months between 4-6.

i want her to come to new york, get married with me that week in city hall, then about 3 weeks later return home to Mexico. i will then wait 2 months and go to Mexico and get married with her only by church (traditional ceremony) can she then get on a plane and return with me home?? (Assuming she flys back while the visa is still valid on her passport)

i guess i could file the AOS before she goes back to Mexico so while were waiting around its processing. but i want to know if she can use the K-1 Visa to leave and enter the country or is it like a 1-time deal thing ?

She can leave.... returning is problematic, as a K-1 is a one-time use visa.

K1 is a one time entry visa.

If she leaves without the greencard or advanced parole you will need to start the visa process all over again (K3 or CR1).

Sorry to disappoint you, but you can't do this. K-1 is a single entry visa.

Once she's here, she's stuck for minimum 3 months (best case, provided that you get married and file for AOS in the first week and everything goes smooth with CIS).

Along with AOS you will be able to file for Advance Parole (Travel Document) that will enable her to re-enter the US. Processing time for AP is 60-90 days from filing if all your papers are in order and if nothing unforeseen happens.

Sorry No. She needs to enter, marry, then file including for AP which will then allow her to travel.

The K1 will be valid for 6 months. (4 months is the validity of the approved petition.)

Do not let her leave the Country without AP. As others have stated ...it's a one time entry. She leaves without AP... you start all over. You can file for AOS (with ap & ead) as soon as you're married and can request the AP be expedited. I know several people who have received it fairly quick. Maybe that will work for you.

I don't think she can re enter US with K-1 visa, but after you got married, you can apply I-485 (Application to register permanent residence). While they processing this application, you can apply travel document (I-131) for your wife (it's cost $305.00) for re enter US. Good Luck.

Just to reiterate what I posted above so there is no confusion... AP (I-131) and EAD (I-765) are both included in the AOS (I-485) fee of $1,010. You do not (usually) file for it separately when entering on a K1.

Here is a step by step guide.

Since AP fees are inclusive with the I-485 fee, no additional fee is required when submitting the I-131 in conjunction with or after the I-485 application.

wowwwwwww i really thought it would work out the way i wanted it to. so if she comes into the country shes stuck here until she gets her greencard and travel document............ damn. so now either she waits in mexico till the traditional wedding (april 2009) or she comes now and stays with me and forgets about the wedding...... tough choice.

She can come here to the US, get married at the courthouse, apply and get her AP/EAD/GC (she'll need her AP if she doesn't get her GC first), then go back with you to Mexico to have a "traditional", and/or church marriage in 2009. Nothing wrong with that. A lot of people because they want to get their paperwork done up and out right after marriage, have something simple, get their paperwork done, and then later have a bigger celebration with family etc. and then go on a honeymoon.

If she has her interview and is granted a visa however, she must use the visa within 6 months, and you must get married 90 days after she's entered the US. So if a April 2009 wedding is later than the previous information I just gave you, then no, she can't stay in Mexico until the wedding. And a K-1 means that you have to get married in the US.
