There was no stokes. The officer called us in, said he had reviewed our case throughly and that we had a strong case, then he asked us what happened in the first interview? We told him the officer told us we got everything right but that he had a problem with our age difference.

He said, we USCIS are a government agency and do not discriminate. Then he asked for my passport, EAD and approved. All in less than 5 minutes...

I spent $550 for attorney presence and $250 to be prepared for the stokes... but I still don't regret it.

03/27/2008 - RFE Letter : Dated.

03/31/2008 - RFE snail mail rec'd date ( EZ-864 / Missing birth certificate).

04/01/2008 - Mailed RFE response.

04/03/2008 - RFE document delivered to Lees Summit, MO @ 4:03 P.M:

04/07/2008 - AOS Touched, Current status: Response to rfe received, and case processing has resumed.

04/08/2008 - AOS Touched.

05/27/2008 - AOS Touched, received USCIS email indicated case transfered to CSC.

05/29/2008 - AOS Touched.

05/31/2008 - USCIS snail mail stating I-485 has been transferred to CSC to speedup processing.

06/03/2008 - Received email from CSC confirming reception of transferred I-485.

08/28/2008 - Green card rec'd in mail.

06/11/2008 - I-131 Approval email received.

You shouldnt regret it, I'm sure seeing your lawyer right next to you made an impression on the IO. Nobody wants to get sued based on discrimination don't you think??

March 13, 2009 : NOA 1 received on I-485, I-130, I-765. Dated March 11th, 09
March 17, 2009 : Biometrics Letter recieved (Dated 13th March). Interview on 1st week of April
April 2, 2009 : Biometrics done. Total time taken with wait 20 mins.
April 22, 2009 : Called USCIS. They have received fingerprints and work permit is in process.
May 7, 2009 : I-765 case online. Card Production ordered.
May 11,2009 : EAD card received.
May 12,2009 : Applied for SSN.
May 18,2009 : Received SS card.
June 08,2009 : Received Letter for Interview ( scheduled on July 14 th July )
July 14th : Great Interview. All done in 20 mins.
July 18th: Online status - Card Production ordered. Thank God !! I-130 online status : Pending
July 23rd : Welcome to USA & I-130 approval letter recieved. Online status still shows pending.

Thanks everybody. I know a lot of folks here do everything by themselves. But I have to say that having a lawyer made my case possible. I believe that if we had brought him to the first interview, they would have approved us right there.

My lawyer also managed to get USCIS to schedule our 2nd interview. After the first interview we waited 3 months and had the lawyer sent a letter to the supervisor in Newark and in 2-3 weeks we received the 2nd interview.

Congratulations! I just read over what happened at your first interview, and I'm so happy that it eventually worked out for you guys (as it should have the first time).

Our journey:

4/30/08 - AOS/EAD/AP mailed to Chicago lockbox

5/1/08 - packaged rcvd at lockbox

5/8/08 - All 3 NOAs received (dated 5/6)

5/8/08 - check cashed

5/10/08 - Biometrics letter received

5/27/08 - Biometrics appointment

6/10/08 - case transferred to CSC - YAY!

7/11/08 - rcvd emails that EAD card ordered and AP approved!

7/18/08 - AP rcvd

7/19/08 - EAD rcvd
