Where did yuo file? Vermont or Cali?

IF Cali I thinkt here is a great chance that your I129f and I130 will be approved together as the rest. The vermont center is still on last month pattern. I am away on buisness so I have not had time to check.

but I read you in another forum. I got really excited for you.

Lurking... What do you think? My K-3 Visa was touched yesterday after almost one month of not being touched and it was supposedly "Administratively closed" as of 1/24/08... I don't know what to think about that touch??

I did write a letter to USCIS to reconsider re-opening my K-3 Visa, but I am not sure if that's why the touch yesterday.

What is your Opinion on this?

I am here to let everyone know that my K3 petition that was approved on the same day as I-130 on Jan. 9, 2008, has finally made it to the NVC and was assigned a case number. K3'S ARE STILL ALIVE!!!! Hope this gives others hope.

Hello Lurking,

I am not sure if you saw my post from last night or not, so I will post it once more. I am Deb from the Nigerian couple "Adewunmi and Debra" whose I-130 and I-129F were approved on the same day, Jan. 9, 2008. I just found out late last night that my K3 petition is finally at the NVC and assigned a case number and will probably be on its way to Lagos in 2-3 days. I noticed that our names had disappeared off your list. I just wanted to be able to give hope once more to other K-3 filers that filed after the fee increase and did not pay a fee for their I-129F.

Ok, so this caught my eye. A few of these have dates after or near mine (I-129F / NOA1), and NOA2 much sooner that I thought it would happen.

Now this seems a little bit out of order in my opinion. Of course it could be considered sour grapes on my account, but I am REALLY happy for those that are receiving NOA2 so quickly and hope it continues for everyone.

Two of those listed received NOA2 shortly after NOA1. Even though one is VSC, those can not be in order of arrival, so I think USCIA ether has a giant pile they pick through, or they simply lie.

The two I am referring to are:

This is good news, as long as they keep moving along quickly.

I contacted my congressman regarding my I-130 and I-129F petition for my wife because I don't get an answer when I call USCIS. Following is congressman's office's response regarding our case

"Folowing up with the USCIS VSC this afternoon after receiving your message, I was told that filing the I-129F petition so long after submitting the I-130 petition had reverse effect of what you had intended - it actually slowed down the processing as the two files needs to be combined. This can be rather laborious process. However, the petitions are now waiting to be picked up by an adjucating officer."

Go figure....I couldn't submit I-129F earlier because I did not have the NOA1 until Jan 16, 08!!! Well this explains most of the delays.

i received hard copy NOA2 for both of my petitions and on both it says that my files will be forwarded to the NVC. I thought that only K3 is forwarded to the NVC and 130 is held for AOS. What should i do now as I want to receive the earliest interview date and that can only happen with K3 right?

If your I-130 NOA2 doesn't say your relative is in the USA, then yes, both petitions will go to NVC. The I-129F is likely to get an interview date before the I-130 but for the I-130 to even get through NVC to the Consulate, you must interact and pay fees. As such, by ignoring it, you can assure the K3 visa is the result.

On the other hand, by pushing it through, your spouse could end up with the far superior CR1 visa in about the same time.
