Filling CR1 for expired F-1, with 17 age gap difference

We are getting out papers ready to apply for my spouse, who is F1 student but he left school  6 months already and his Visa is expired in January 2017.  I just want to know if we will run in to problems with 17 years age difference.  I have 3 childrens from previous relationship never got married to him.  I have gas bills, electric, water, bank accounts, pictures, letters from family.  I was married once in 1997 to USC but divorce 2 years later have no children with him.  I'm planning to file I130, I485 and I765.  Please help, I fell confident but a little nervous about age gap.  I'm 45 look like 30 with young souls and my husband is 28 look like 30 with very old souls we get alone really well.

I'm a bit confused...are you filing for a CR-1 or AOS? AOS can only be filed if your spouse the US already. You noted the I-485, which is for AOS, not a CR-1.

45-yr old USC marrying 28-yr old foreigner will be scrutinized.. irrespective of looks. I'd send in all sets of evidence in support of a bonafide relationship. Having entered on an F1, dropping school, and overstaying.. all likely to be looked at.

Sorry I'm new to VJ, I'm filling AOS, I know this is going to be a difficult journey, that's why I'm looking for your helps to be more prepare, if you have any advices please let me know what I should do

No problem...just wanted to clarify.

The 17 year gap will likely be taken into consideration, but good evidence should be sufficient to overcome that. Plenty of people have done AOS with larger gaps.

I don't totally agree on this one. It really depends on the country, culture, family, norm, who is the older one and so on.... Not all will be scrutinized over that.

Yes but that's not what you wrote you wrote it like it was everybody with a big age difference. 

 

I agree with you that they most likely will be scrutinized. But I don't believe that everyone will be it no matter what.

1. Woman is older, 18 yrs gap is a lot.

2. Single mom to 3 kids.

 

Be ready for a rough ride. USCIS doesn't care if you look young with young soul. Good Luck.

I know it going to be a rough ride, if having strong   Evidences is enough, joint checking account, name on gas, electric, water, cable, life insurance, car title, notarized letter from family. We are planning to do the paper work ourself and hired an attorney to go with us for the interview.
