I am sorry to bother all of you with a mess I have put myself in,but advice of any kind will be appreciated.Iv got married thru k1,btw I was petitioner,as soon as my ex got GC he went back to his Country of origin without of me knowing.I started my own little  investigation finding out he has baby mama and two kids there who he never separated  from,she is in his house,his family is calling her daughter in law, she is talking about  herself as his wife.I have all the pics and conversions between her and his brother, sisters,his other family members.But everything is on his language.I am planning  to go to local USCIS, but I am wondering  if that is good evidence,because is not on English.It is time for his ROC,he has dwi and not to much of evidence.One year of tax return,sams club membership,he was never on any utility bill,he never participate in household bills.Thank you all for taking time to read and please guide  me,whats best thing to do.

It sounds like you aren't married anymore. If so, he can still ROC without you via a divorce waiver. That said, if you have proof that the marriage was not entered into in good faith, then submitting it to USCIS/ICE would be an appropriate course. They will look at any evidence from an ex with lots of skepticism, but it's the best you can do.

 

Do you know if he was married to the girl back home while married to you or before coming to the US on the K-1? If so, that's clearly fraud. If he married her even right after your divorce, he can claim he fell in love with her after your marriage. Did he list his children on any immigration paperwork? If not, that's at least misrepresentation. The fact that the evidence is not in English is irrelevant. Just have a translation provided as well. However, remarks from others is not particularly strong evidence IMHO...it's hearsay. It may be enough for somebody to scrutizine more heavily to figure out if the claims are true or not, but it's not "proof" of anything.

 

Beyond reporting it and providing the evidence, there's nothing else you can do or should worry about. It's his process now.

 

Edit: And with that little proof of a bona fide relationship, getting through ROC sounds like an uphill battle already.

Thank you for replying.He was never legally married to her,but they have been living together for a long time.One child was under 1 year old when we got married.As much as I know girl was in all this with him,I guess he promised to her to bring her here after everything is done.I was never introduced to any of his family members nor they know about me.His kids werent on documents on any of app until ROC and I think he disclosed them know on waiver.I'v already reported him to ICE via tip line,but I dont know if they are looking in to.Thanks do for your info.

Thank you,just hoping they will check all his documents,from embassy too.I was talking with some organisation and they have his app for tourist visa he applied just couple months before we meet,where he stated he was married with kids,and on k-1 he is single.

I'm sorry your marriage did not work out as you wanted it to. Let me ask you this... Did you ever meet his family or his friends in his country? I honestly don't know what can be done at this point. But if he hid that he had a woman and kids in his country, then that is major fraud.

Thank you so much,I know it was my fault for letting this happend.No,never meet any of them,never spoke with any of them,after we separated some people came forward and told me about everything,about his 3,4 fake facebook profiles he used to be in contact with his family.When he went back to visit his I guess wife and kids she was posting their pics all over fb,talking about her husband.

Hello, Were you able to print out or take photos of the Facebook posts? These are what trip a lot of people up. Usually fakers cannot keep their mouths shut, so you can send them to USCIS with an accompanying documentation. If he had the wife (baby mama) AND kids without telling USCIS, then this would be fraud.

but if he left and live abroad to return now would be a good

time to report it to CBP so they get him at the airport on

that DWI, and your alleged fraud complaint, if he is in the

US now it may just be too hard to have ICE remove him,

go ahead report it to CBP and ICE then forget him,

women makes gross mistakes when we meet men with

babies under 5 yts and jump into a relationship anyways,

personally that would be my turn off at the beginning

She didn't know about the baby. He hid the fact he had a child from her, and the US government.

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. 16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site
