AOS of a B2 visa with I-94 about to expire

Hi, how are yall?

Im about to submit the application for AOS.

I was admited with tourist (B2) and my i-94 is about to expire and im only pending a single document to send the application, witch is a W2 form from one of my Sponsors.

I would like to now if there is a problems sending the application after some days of my I-94 expires. Do i have to do something extra or change my application?

Background:

Arrived: 03 November 2015

I-94 Good through 02 May 2016

Passport Good Through 2020

Visa Good Through 2023

im Married to a USC.

Nope you're good, the overstay is forgiven for spouses :-) Remember to file for EAD and AP so that you can travel and work faster if need be :-)

Im following the step-by-step posted here and got pretty much everything to send.

I wonder if there is a time limit to send the AOS after I-94 expires.

There's no time limit :-)

However, the inconvenience if being out of status should serve as an incentive to get it over with :-)

If it isn't difficult, it isn't worth it.

it doesn't matter if you are out of status when you submit the packet, you will be out of status anyway, since the process takes months

overstay is forgiven

But they will be in a period of authorized stay once they file.

KayDeeCee, I'm sorry I'd place this post here.
I've thought here would be apropriate.

Another question:

I read somewhere that you can stay out of status and submit the AOS within 180 days without paying any extra fee. After that period, you have to pay something like $1000 extra dollars. Is that correct? Is there any extra fee for overstayed periods?

I might be misinterpreting or misunderstanding the information, but it gave me a doubt.

In your case you can be out of status for an unlimited of time and submit AOS without any "fee". I am not sure where you got that from.

The "fee" might be a confusion with the 245(i) process, where people who were petitioned before 2001 can file AOS (in any category) even without having entered legally and without having status. That AOS application has an extra fee. Also, that has nothing to do with any "180 days", so not sure what that's about. Perhaps it's a confusion with the fact that employment-based AOS filers could have had up to a cumulative 180 days of not having status and still qualify for AOS under INA 245(k); this is a completely separate thing without anything to do with any "fee".

That pretty much clarifies everything.

I was confused is witch case I could put myself in.

Reading the rules this way is much better than the actual article of the law.
