Refile K1 after denied Visa

The strength of evidence necessary to be granted a visa in Manila tends to be far different from what's necessary almost anywhere else. The OP should front-load his new petition package exactly as Ebunoluwa recommends.

Ah, that is true. What with the many disasters that went on in the Philippines, I suppose it's a good time for Filipinos to get a K-1, as the Manila Embassy seems a bit more relaxed in granting K-1's, yea?

I always thought the K1 petition was more relaxed for folks with fiancé/fiancée from the Philippine (especially the short visits required before filing the petition, am I wrong)? Getting a visitor visa is a different story, based on what I've read on VJ.

There are natural/manmade disasters all around the world, and how does one determine one is more important than another for immigration purpose (I imagine having close ties with the US makes a huge difference)?

I wanted to apply for a K1 visa for my wife, before we got married, I was skeptical she will get a K1, we would have to wait 10 months and if it does not work, wait again, so we decided to get married and apply for CR1 instead.

Hi all

Unfortunately our fiance interview did not go well, she got denied a visa and so was everybody else who filed as fiance or marriage that day. I did everything i was told to do through this site but it didn't seem to matter to the consulate who interview us in Cambodia. Cambodia is a blacklist country and its very hard to get approve if you are applying for K1 visa for the first time or even second. I have to congratulate those who passed on their first try. It seems to me that they have already made up their mind about who will get a visa before you even step to the window for the interview. I am very disappointed with the decision but there is nothing we can do about it now but to refile. So I'm in a process of refiling it again and my question is, will it be shorter this time around for the application to process? First time it took her 10.5 months to get an interview. I hope it doesn't take that long again. I've talked to some people who also was at the interview and they told me that they have been interviewed 3-4 times already, but i did not ask them how long it took them to get each interview. I just hope it wont be too long because waiting really sucks!!!

Agree with TBoneTx completely. I dealt with Manila, which is a "walk" in the park compared to some of the countries I read about.

I might try one more time, then it would be time for a spousal visa, if that is in your thinking.

You are in TSC, and all the petitions are going to CSC, so it might be quicker.

You said some people have been turned down 3-4 times.,.,., I am a big advocate of K-1, but a CR-1, might be your best thing to do.

It is a shame that things like this have to happen to legit couples, trying just to be united.

Good luck on the next try.

Umka36, USCIS made this decision about the Philippines, I have been there, after both disasters, I know they need help.

Us members of VJ, had nothing to do with the USCIS expediting fiance visas. I just wish you could have seen the devastation, there, you might understand a little more if you did.

Yes, it seems unfair, all I can say is you would have to see it to understand.

Been there, seen all the deaths and destruction.

Good luck on your journey, as I wish it was all totally equal, but we are dealing with the USCIS,..,.that tells the story..,.,,. USCIS>

Correct, too many photos suggests you are desperately trying to prove something. Instead of quantity, think quality. Send like 10 good pictures, but tell a timeline story. Use pictures from various points in your relationship up to the point of your engagement. My wife and I just used pics from our one trip in Singapore. We told the story of our trip in 10 pictures, from the initial airport meeting to the day I gave her the ring.

In addition, we front-loaded with the following (from our trip):

1. Airplane Ticket Stubs

2. Pictures of our passport Stamps

3. About 5 receipts from Singapore (hotel, shops, cafes, gifts, etc)

4. A few pics us near Singaporean landmarks.

To prove we kept in contact, we did not send hundreds of pages of text logs, we simply printed out 1-2 pages of random chat logs for each month we dated. Some chats included fights we had, and while some may think that is negative, I felt it only made our relationship look more natural. In addition I sent gift receipts, WU receipts, and copies of emails.

*Note: We only saw each other once for 2 weeks. I would recommend you send 10 very good, story-telling pics for every 2 weeks you been together. Keep them separated in plastic baggies and label them per visit (Visit to Cambodia, 1st Visit Week 1, Visit to Cambodia, 1st Visit Week 2, Visit to Cambodia, 2nd Visit Week 1, etc.)

Forgive me for starting (a new) topic, but I have a relevant question regarding your post. When front-loading, did you use the original airline ticket stubs or did you make copies? I'm assuming those were submitted with the original I-129F package, correct?

Sorry to hear the news...it's just not fair.

But that said, Thomas Edison said something to the effect of...

"Insanity is doing the same thing again while expecting a different result".

I'm sure some folks can succeed in second K1 visa try, but if you are dealing with

a difficult consulate, what will be significantly different in your second K1 visa?

I think it's better to get married in her country and file for spouse visa.

If you are 100% sure that this is the woman you want to be with,

perhaps even having a baby together ASAP will strengthen the bona fide

relationship perception.

Best of luck...

I've been married for 4 years , and I applied for a visiting visa just for a couple of month , all those who were interviewed approved the visa , when it came to me they sent me to another Visa Officer , I could read his facial expression while holding my Sudanese passport " Sudan is supposed to be among the enemy countries to US" , he immediately denied me the visa and refused to listen to any explanation or see any of my documents that proved my coming back , he even asked the security guard to take me out . He was very rude and very racist.

I came to the US as a refugee myself after a US involved war, so I understand. There are always going to be disasters around the world, and I'm not here to say which is more deserving than the other. The Philippines are close allies with the US, so I'm not surprised they expedited the process due to the natural disasters. It is what it is, but most of us know that the process/experience in the Philippines is more "relaxed" than most countries.

I wish you luck on your VJ as well.

the Manila Embassy seems a bit more relaxed in granting K-1's, yea?

This is an understatement. Bluntly speaking: Especially in comparison with other places, the Manila embassy hands out K-1 visas like candy.

I dealt with Manila, which is a "walk" in the park compared to some of the countries I read about.

This is accurate.

Forgive me for starting (a new) topic, but I have a relevant question regarding your post. When front-loading, did you use the original airline ticket stubs or did you make copies? I'm assuming those were submitted with the original I-129F package, correct?

Original items are specified. Otherwise, copies are accepted in the petition package. Save the originals for the visa interview.

The reason for denial must be addressed

Again, this. ^^

perhaps even having a baby together ASAP will strengthen the bona fide relationship perception.

All that this shows is that two people had sex. In addition, consider the consequences of creating a baby who might be stuck halfway around the world in a desperately poor country with a mother who can't get a visa, and without the father who can't pull up stakes and move there from the U.S.

I emphasize that the OP should read the Embassy Info and Reviews: Embassy (links atop any VJ page) for Cambodia, and painstakingly pore through relevant threads in the regional forum -- paying closest attention to the very worst experiences and how people surmounted them.

Interesting

I expected that it would be difficult to get a B in Egypt.

There is a linkage, most countries share the same issues. I am aware of the odd exception, just did not think Egypt was one of them.
