DID NOT get an I-94 for K1 visa entry.....

Hey guys, not sure what happned when I came at JFK but the officer who processed me did not give me an I-94 or finger print me a second time like I have read people did before.... does any one know why? Is this becasue of the automation of the I-94 form thing? He also spoke with other officers about it and seemed confused so I am not sure what is going on.... Can I still file the AOS using the passport stamp alone?

Paper I-94 are going the way of the Do Do bird, and being replaced by an electronic version.

I94 are now accessed electronically. You can print a copy at www.cbp.gov/i94. You can find this information on the USCIS website.

You need an I-94.  You need to go to a CBP "deferred inspection site" and get a new one for free because they made a mistake.

It doesn't say it applies to a K-1 visa.  It says it applies for "foreign travellers" whatever that means.  Do you (or anyone) have any information that it applies to all visa classes?  K-1 is sort of "special."

OP: to get a quick answer, you can call CBP on the phone and ask them if the electronic I-94 system applies to K-1 visa holders.

 

It's possible in all the hullabaloo they made a mistake.  It happens and it can be fixed by going to a deferred inspection site.

 

It's also possible that it did go electronic and there is a delay in updating the site.

I was just going though Honolulu Immigration today. My fiancee will come from the Philippines on Thursday. People on the plane who were immigrating were told to fill out a customs form AND I-94 form...but...I overheard some of the immigration officers saying that K-1 visa holders do not fill out an I-94 form on the plane. It is generated for you when you are processed through immigration. Just fill out the blue customs forms. I asked an officer and he confirmed that k-1 visa holders used to have to fill out the form before landing but now it is generated electronically for you.

My fiance entered the US on June 6th and he was not given an I-94 form, I assume because it is now automated. However, when we put his information into the CBP website it says his record is Not Found. Is anyone else having this problem? It is now June 12th, do you know how long it should take to be in the system?

Should be in there already. You can check with a deferred inspection site to see if your information is in the system correctly > http://www.cbp.gov/x..._inspection.xml

Make sure you have everything entered correctly spelling of name, class etc.   I mixed up the order of name first middle vs middle first.  This MATTERS. Enter it exactly as your Visa in the passport is listed.

I 94 it self says to be filled out by people EXEPT U.S. citizens,returning resident aliens and allies with immigrant VISA (that's a K1).so no you do not need to fill out an I94

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?
09-25-2007 = Touch (first-ever).
09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).
10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."
12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.
12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.
12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.
01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.
01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.
04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").
05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.
05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).
06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."
07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.
08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).
08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
