Hello everyone.

I have finally gotten the long visa process done, we are married...done. Now, its time for the change of status. However. Recent events have shown me that maybe this was not what I planned. I am finding things that make me feel like this was a total mistake. What should I do? I think it would be best if he went back home. The relationship is not working out and I honestly feel as if he is with me for a green card. what can I do? How can I have him sent back home? We have not filed the change of status and I don't intend on doing so, especially feeling this way. please tell me what I can do? or is there anything I can do to have him moved back home?

You can't have him sent back home. You can divorce, not file AOS paperwork, and suggest to him to return home.

If you cannot work out the differences divorce him and let him fix his legal status hell have to prove a genuine and relationship comiggling and so on if he cannot hell have a hard time adjusting his status here...

If you cannot work out the differences divorce him and let him fix his legal status hell have to prove a genuine and relationship comiggling and so on if he cannot hell have a hard time adjusting his status here...

How long have you been married??

I have been married for over a month now and its been Hell. Even if he doesn't leave, I have no issue with him staying here. its just the principal. I kept my promises and he didn't.

well one month married however you know this isn't a over night process. I have been with him for 5 years. so, this is how I can see the contrast of what he was when he was overseas and what he is now. hes not a bad person. I just know that we aren't happy and he has not been honest. I have already forgiven him however im just considering my options.

If you divorce and do not file his AOS he has no way to do it himself unless you've been abusive.

You can't make him leave however.

As a K-1, his only hope of a green card is through his marriage to you, or through abuse committed by you (and then filing for a VAWA).

You can not send him home, but those are his only two legal paths to stay here.

If he used you for a green card, and if he knows that those are his only options, then you need to be careful.

Once he realizes that you have no intention of filing for a green card, he may try to set you up for an abuse case.

We have seen it happen here before, so it is best to protect yourself.

If you decide on a divorce, then leave all communication between lawyers and do not have any contact with him.

Of course, he will have no work permit so he may accept a plane ticket back to his home country.

He has to do adjustment of status through you or go home as others have said. Other than abuse there is no other way to a green card for

him. You mean for 5 years there weren't any flags that he wasn't genuine ? Five years is a long time. How many times did
you visit and how long did you stay ? How much did you communicate ?
One month is nothing and I hope it's not just an adjustment issue. Hope you can work it through, if not then move on and don't
worry about his status, it will be his problem. No, you can not send him back, let immigration handle the rest.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Ah ok i understand but i mean 1 month of marriage for his visa process it doesnt look good when he needs to adjust I believe...however i could be wrong...he can say you tried to abuse him and file vawa

You can always write a letter to withdraw your I-864 to UCIS.

OP stated they have not filed nor does she intent to help him with it.
