Dont know which way to go K3 or CR-1

Timeline

I don't know whether to apply for a I-30 and go the CR 1 route after we marry or wait to marry and do the fiance visa route. We want him here in the US as quickly as possible and don't want to be apart anymore. Can someone help point me in the right direction.

They don't really do K-3 anymore.

CR-1 takes about a year, but they get a green card when they get there and can work right away

K-1 is the Fiancé visa. Takes about 4-6 monts right now. But Adjustment of Status is needed after the wedding and the person will not be allowed to work for about 60-90 days from you sent in the AOS package.

Spousal vs fiance visa is really a personal choice I believe. You have to do what's best for you and your fiance. Research all the pros and cons to both processes and make a decision that best suits your situation. For me personally, we did not want to be separated after marriage so we chose K1.

Yea, I wouldn't bet on that. I would do your research before you go. Read up in the Algeria portal and see what other couples have gone through and experienced. Read up on AP and what the AP length times range from for your embassy. Please do not go into it blindly thinking that just because you marry that the CO will believe everything is wonderful and bonafide.

With a CR1 it is a bit longer than the K1 process but there is no AOS so that is a plus. Once you decide which route you're going take the need documents and forms for his signature with you so he can complete them and you can bring them back with you. Saves alot of time, money, and hassle.

Also, k1 I believe u can't have a co sponser, so if u need one a cr1 is better. Algeria Is a mess to marry in, if u chose to marry.... go to Tunisia. You can get it done in a week vs 4 months.

1/15/2016 Called NVC and got case/invoice number logged into this site to pay fees, pick agent -> https://ceac.state.gov/IV/Login.aspx 1/15/2016 picked agent DS-261

1/18/2016 paid aos fee

1/28/2016 review 261 to get iv fee unlocked ( unlocked once I did review,was taking to long)

2/1/ 2016 sent AOS & IV packets together to nvc while I waited for iv fee to open to save time.

2/4/2016 paid IV Fee and waited to do ds260

2/3/2016 nvc received aos and iv packets(scan date)

2/7/2016 ds260 completed and now waiting for cc

3/11/15 interview email

4/20/15 shots 4/25/15 rest of medical exam

INTERVIEW APRIL 27TH @8:30

April 27th 221g for additional documentation and placed in administrative processsing.

Everyone who is doing a CR-1 visa is already married. That's a pre-requisite for that visa category. So there is no special treatment because you're married, you join the thousands of others in the same situation and we all have to wait. Prepare for it taking about a year. None of us is enjoying the process. But we do what we have to do.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

As many have already stated, the CR1 vs K1 is really a personal choice. Based on the current processing times, you would most likely be together in the US quicker (potentially within six months) with the K1 assuming you have a fairly simple application (no criminal, or drug issues, etc.). However, you would then need to do the AOS which can take from five to twelve months or more for the Green Card but he would likely have employment authorization within 90 days of filing the AOS. I am not familiar with Algeria, or any issues with processing K1s there, so I would check the regional forums for that information. Others have already stated the advantages of the CR1, so I won't repeat them. In our case, we felt the same way about wanting to be together during the AOS process, so we went the K1 route. At least you are doing the right thing by asking questions and looking for information.

After a long few days of struggling with the decision we finally decided to go the K1 route. In the end we want to be together and not apart because really neither of us has the money and I don't get that much time off from work. I just explained to him that we will have the same out come but we will just be doing it backwards and together faster. It's a no brainer. If we made it this far then we can make it another 6-8 months. I just can't see doing it the hard way and being away from each other for over a year with the CR1. Thank you all for your advice and help. I can't wait till I actually get to start filling out our time line .

K1 as long as u have met within 2 year face to face.... should be no problems. Algeria Is a tuff embassy if your older than him fyi. Have lots of evidenced... u can see by my timeline, it's moving quickly even for cr1 visa. We chose this one so we could stay together alone. Also came with the green card so he can work. Good luck...
