Hello everyone,

So me and my fiancé we have so big difference of age, but we fill all the instructions of the k1 ,we have proof that we met before,proof of us Citizenship,the intent to marry...everything !

I wounder if the difference of age can be taken as fraud by USCIS ( i am adult of 23 years old)

Please help!

If you are 23 year old male from Middle East or Africa and she is 40 y.o. female from US than the answer is yes. It will be considered a fraud. And in 99% of cases it is. Simply due to the culture, acceptance in the region. Plain and simple. If the other way around depends.

am 23 years old i live in france but i am not french i am tunisian, he is the 56 years old male,what prooves to the USCIS that it is a fraud?! , if we marry and they take this as a fraud what will they do?,make as divorce?!

depends how you ended up in France. A lot of variables. Trust me, COs benn there done that. They sniff out fraud immediately.

If you are 23 y o from Tunis that came to France and not resident they will deny. If you don't have any status in France it smells fishy even to me. Not to mention co. Came to France. Did not get status. Took on us citizen who is 56 y.o. .. Do you think COs are idiots?

As others have said it depends.

And in your case there seems to be a lot more to it that may be considered pertinent facts.

I do have status in france,i am a student of economy,i reside here with resident card,do you think it is better i make tourist visa and go to USA and spend some months with him, take pictures ,travel together,make relation album,make picture with his freinds...,+i make copy of my residen e in france,than i enter to france and apply for k-1,do you think this can help for the application ?

I don't think you'll have any problem, so long as your relationship is genuine and you can show that, the age difference, or your nationality is not an issue. The fact that you are living legally in France helps - people living legally in Western Europe have less incentive to use fraud to live in another Western country.

There is a tv show in the US called 90 day fiance. You should see the people who've been approved for k1s on that show!

I went through AOS not K1, but I and my husband have 17 years age difference, I am 25 and he is 42. nobody ever asked us during process about our age difference. I dont think you have anything to be worried about when your relationship is real.

Age gap is a fraud INDICATOR and not automatically seen as fraud like some here may think. It depends on the big picture of your entire

submitted package and other variables.

In your case I would not worry but carefully select all relevant relationship evidence and front load your petition, not just bare bones.

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
