July 2013 I-130 Filers

We have seen quite a few transfers here at VJ. I think the count is up to 12, and they're all February filers. What we do not know is how long their petitions will sit waiting in their new location. I hope it is not like the treatment of our petitions at the field offices!

As for volumes being high, if you are speaking of I-130s, I strongly disagree. If you check on USCIS national processing volumes and trends, there has been little change in the volume of I-130s over the past year, not different from anything they have experienced before.

In other words, we didn't get a fair shake. We were the sacrificial lambs.

They really owe it to us for putting us on the back burner for so many months. I can say the word "owe" because we all paid in full, but so far have received abysmal service.

At the end of August, I called USCIS to update the beneficiary's last name. At the start of Oct, I was told that they haven't gotten to the box with my file, yet. Today I get an email saying that USCIS got around to my file to correct the name.

My file is at Overland Pk, KS. I am a 7/30 filer. Hopefully this means that Overland Pk is operational and they are working on files. I hope to get an NOA2 soon since my file was actually worked on.

Can't their spouse enter the USA, and then they file AOS and just change the form and then the spouse can stay in the USA while their I-485 is being processed?

No, using a visitor visa for immigration is visa fraud.

I have a friend from Canada who tried to cross the border into the U.S. as a visitor (with the intent to leave after 6 months, but in the meantime begin processing her I-130 here) with her husband and two kids in the car. But she was turned away by Customs. She refuses to talk about it on her facebook and I'm trying to figure out what might have happened and what the ramifications for her might have been. Could she have been banned for life or something to that effect? Isn't what she was doing Immigration Fraud?

No. It would be immigration fraud is she came to the US on tourist visa and stayed.

Being denied entry has no effect whatsoever on CR-1 process.

My understanding that for IR-1 Visa's

You can do Processing at the Embassy (through NVC) OR Adjustment of Status (I-485)

No, they haven't. Entering the country with a non-immigrant visa with an immigrant intent is not legal. If you entered without it and then in course of your stay got married (though didn't initially plan to), then you can file for AoS. But they're already married.

If it was an option everyone here would first get tourist visa, get married, move to the US and file for AoS. But for some reason they don't. Probably because they like being away from each other so much,

I always wonder how one could prove the intent to immigrate. One could just say I didn't have intent to immigrate. You could quit the job after coming here and you could do everything after coming and just saying you didn't come to stay permanently but you just changed later. Total gray area. I think AOS from visiting visa should be banned. Well not going to happen, since USCIS lately support illegal immigration.
