We are about to start the AOS but Im seeing we need a I-94 as well as other documents. Not exactly sure what this I-94 form is. Is it something my fiancee recieved upon her arrival here in the US? She recieved nothing upon her arrival here, only just gave immigration the brown envelope. Was she supposed to get something back? PLease help with any info thnx guys.

Open her passport.

Go to the K-1 visa page.

The I-94 is her entry document; it has some numbers you will need for the AOS.

That is what she had to get at her POE from the immigration official.

You need to start the AOS within 3 months of the date on the I-94.

No. The red numbers are her visa number.

The I-94 is a card that she should have filled out on the plane. Ryan gave a link to a picture of this card. Here's the picture on the page he linked to:

The CBP officer separates the top and bottom sections of the I-94 and keeps the top section. They stamp the bottom portion with a CBP entry stamp that includes the date of expiration, and they write in the visa type (K1). They then staple this to the opposite page from the visa in the passport.

Show your wife this picture and see if she remembers filling out this form before going through the immigration checkpoint. If she did, ask her what the CBP officer did with it. If she doesn't have it then you might need to get a replacement. You'd need to file an I-102. The filing fee is $320. The instructions are here:

The I-94 is a card stapled into the passport (usally opposite the K-1 page).

If you don't have it you have to get it replaced as Jim said (for a fee).

My wife's family name was misspelled on the I-94 at her POE in Anchorage,

so we had to go to the "Deferred Inspections Unit" at JFK and have them

re-issue an I-94 with the corrected name (name was misspelled by

the immigration officer in Anchorage), no charge.

Ahhh. I went through all this nightmare a few months ago. So I guess I can help.

Here is the story of my "Missing I-94" journey:

The big question is: Is the visa stamped?

Do you still have the boarding pass?

- Sometime I-94 isn't stapled onto the passport. Make sure it's not somewhere else.

- If you can not find it, try to go to a Deffered Inspection site with the boarding pass and your documents:

- Schedule an Infopass, explain your problem, schedule one asap. Even though sometimes it's no help, it will be recorded somewhere.

If the deffered inspection site doesn't want to issue a I-94, nothing is lost.

You are allowed to file for AoS with no I-94. The burden to show that you (or your fiancée) entered the US territories is still yours so...

Instead of the I-94, you provide a copy of passport cover, passport ID page, K1 visa with the stamp and additionnal proof like a copy of the boarding pass.

You also need to provide a timeline and explanation of your arrival in the US.

That is what I ended up doing, and... It worked. I got my GC in a 2 month delay. With no interview.

I just did what the USCIS officer advised me to do at the infopass. She told me that filing for I-102 is stupid. (Sorry guys)

Ok now back to question one: was the visa at least stamped?

And there is no dead line for you to file for AoS, as long as you got married within 90 days upon arrival.

But it doesnt really look like the pic that was provided by the poster JimvaPhuong....starting to get worried a little bit if this is something we really need.

Yes there was no form ever stappled to her visa at all, she just has an entry form that she filled out on the plane...upon her arrival to immigration here in houston she gave the I-94 form along with the brown envelope and her visa to the officer but he took the form and never gave it back to her....Im calling the airport tomorrow!!!!! :bonk:

Guess what? If she HAD gotten an I-94 then it would have expired TODAY, according to your timeline. I don't know if there's anything you can do to get the CBP officers at the airport to retroactively issue an I-94 that's already expired just so you can have a number for the AOS.

Maybe you could follow EasternDE's advice and file without the I-94 by providing the other evidence mentioned. :thumbs:

Yeah needless to say I talked with the CBP/ Immigration office at Bush airport and a woman there was very helpfull. I explained to her everything and she got my wifes full name, flight carrier, flight #, what day and etc. She then got my phone number and said she would call me back. But it was at the end of the day sooooooo I will be calling her first thing in the morning. If she cant help us out we will probably be just doing the whole passport/ boarding pass and timeline thing :blush:

Also on the I-485 it asks for your I-94 #...since we probably wont be having one what goes on this line?

Also it asks for current USCIS status, what would go here as well?

Sorry for the questions but Im stressing out :o:o:o

Yeah just wondering we dont have an I-94 and we are about to start the AOS application just wondering what # we put in on the line for I-94# on the I-485 application?

Also if we dont have an I-94 how do we get a SSN?

I cant believe all these services come just from a little piece of paper that nobody really cares about untill you get ready to file for all these things...the CBP/ Immigration never gave my wife hers and now all these problems are coming from this......ugggghhhhh :bonk:

Yes we are aware we can use our passport stamp, boarding passes and writen timeline can be used in place of the I-94...but if anyone can help us we would appreciate it so much thnx. :thumbs:

I don't know much about it but I am pretty sure that they are going to require you to have it if one was technically issued. You will probably need to request a duplicate (which unfortunately costs a big chunk of change).
