Hi everyone. I was in a bad car accident. I broke my back my arms Fractured a rib and broke my collar bone. Doctors say i'm lucky but will still be laid up for 3 months. I received my first notice About my k 1 visa On september first. Is there a way to expedite the process. Do we qualify? My fiance is a nurse. Can some 1 point me in the right direction. Is there a form to fill out and what website would that form. Be at? How much time would this saves us so she could be here and help me. I'm using speech to text to type all of this. Thanks again

Sorry about your accident and your injuries. I hope your feeling better soon.

Maybe you can have someone call the USCIS for you and ask them whether your fiancée's visa can be expedited.

Sorry for your accident but glad you are alive. No you do not qualify for any expediting; only military that are being sent to the front lines do.

You'll have to just wait out the process as normal.

I am not sure "only military" is entirely true. Surely there are some health situations that qualify for an expedite, though I agree this situation would be unlikely to get one.

In three months time (your estimated recovery date), you will likely still be waiting for your NOA2. Your injuries should not impact your process much, if at all.

Good luck to you, though, and hope you recover soon!

So sorry to hear about your accident, but glad you're alive! Unfortunately baron555 is right, only military members being sent to the frontlines qualify for visa expediting. :(

Hopefully your K-1 process is a quick and smooth one, and heres to a speedy recovery!

It can't hurt to try. I just read of someone who has to have surgery on their shoulder and their expedite request got approved because the recovery period is 6 months and they didn't have anyone else to help take care of them. They just submitted a letter from their doctor.

Expedite Criteria

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The burden is on the applicant or petitioner to demonstrate that one or more of the expedite criteria have been met. The criteria are as follows:

Severe financial loss to company or individual

Extreme emergent situation

Humanitarian situation

Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States

Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)

USCIS error

Compelling interest of USCIS

If you are filing your application or petition:

You must provide a written explanation as to why the application or petition needs to be expedited. You may include supporting evidence with the request. Write “EXPEDITE REQUEST” at the top of your letter. When you file your application or petition, place your expedite request letter on the top of your documents.

If you have already filed your application or petition:

You can contact the National Customer Service Center (NCSC) at 1-800-375-5283. The NCSC will take a “service request” and forward your expedite request to the office with jurisdiction over the application or petition. You also have the options of 1). visiting your local office by scheduling an InfoPass appointment or 2). writing a letter to the local office or service center.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

I just tried to open my own link and, for some reason, it's not working. However, the information I provided was copied directly from the USCIS website. Again, I hope you can expedite your case based on your injuries. You should probably get your main doctor or hospital to write a letter explaining the extent of your injuries and your estimated recovery period to send along with your expedite petition.

I remember there was someone on here who had pregnancy complications, resulting in bedrest. They got an expedite approved due to that, so there are medical expedites, but I don't think it is certain you'll get one. Worth trying if you have no family/ friends local to help out though!

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Just a question regarding this. Does active duty military apply at all? I have been hesitant to calling, but I might this week. Also, my fiance has been attacked and robbed twice this year, does anyone know if they could speed it up for that as well?

Not likely it will be expedited. You can ask.

Attacks and robbery do NOT count. Active military does NOT count unless the petitioner is about to be deployed to a COMBAT area, then they will expedite a case.

K1s are generally not eligible for expedite. The exceptions I have heard of were military deployment to a combat area and very. very rare exceptions for medical conditions. The others do not apply to K1s.
