    Thank you for confirming my suspicions that we were about to go down the wrong path.  It's definitely not our intention to commit fraud. However, I wrongfully assumed that she could apply to adjust her status while visiting given that is the only way she can lawfully be in the US.  We will submit an i-824 to have her approved petition sent to the embassy in her country and she will complete the process at home.

    A person can not enter the US via a B2 with the intent to file an I-485.  Visa fraud........even if she was allowed into the US, USCIS will look at the date of the I-130, her entry dates, etc at AOS.........prepare for scrutiny, imo.
     
    I think you possibly have a legal mess on your hands.

    B2 is a NON immigrant visa, does not allow someone to enter with the intent to adjust and stay.

    Yes, the best way to do this is to not intend to adjust on a B2. She can wait out the process at home like she is supposed to...

    We are optimistically but cautiously planning a official ceremony and reception w/ aprox 150 guests in Novemeber. I just figured it I can its better to get it done versus going to the court and trying to plan for something formal later. Leave it to me it for sure wouldn't happen. lol I'm doing as most others that decide to go this route are doing....making sure there is a clause that allows me the change the date if the K-1 process doesn't go as planned. Now I don't plan on sending out formal invitations and encouraging family to buy plane tickets until the visa is in hand...but I did reserve the location (and was able to do so w/ a surprisingly small deposit amount) and am starting to engage other vendors. I have also notified people I wanted in the wedding party and my family of the ideal date.
    It's been ok so far. All I can hope for is the best and then adjust if things don't go as planned.

    Hi all!
    I actually plan on taking my fiance's last name even though I'm fairly established professionally. Call me old-fashion I guess. Plus hyphenating my last name would actually be somewhat comical since my maiden name is Small and my married name will be Dainty. Can you imagine seeing something like that...Jamila Small-Dainty?

    It won't be the same anymore? I think that speaks of deeper issues rather than just unhappiness with USCIS. Yes, it's a garbage process and doesn't work nearly as smoothly as it should for the amount of money we pay for it ... but we're all working towards the same goal and that's to be with our loved ones.
    Personally, as soon as I get my Visa in hand, I won't give two craps about USCIS. Yes, I'll still have to deal with them for my AOS but who cares? I'll be home in the US with my love.

    Advice welcomed.
    My fiance will be married shortly-but we are having our large "Christian Church Wedding" in August of 2011. I have had a group of friends get married recently (maybe that's why we became friends??) who married foreigners and of course they all wanted their families from their native country to be there. In all the cases-all different countries-most in Africa-they were denied. We have some months to plan this, so we want to do whatever is necessary so that 4 of his Nigerian family members can come to our wedding. The usual reason for denying a tourist visa in Nigeria is "not sufficient evidence you have something that will bring you back to Nigeria" His Mom doesn't work-but his Dad's health is too poor for him to come-so I think she's be more likely to pass, but she won't go alone, and his siblings, are either in school (University) or have jobs-like many Nigerians-they are businessmen-so no real issue about them having to get back for their work. What can we do or they do so that it will improve their chances of getting a visa to come to our wedding?

    You will have to submit an affidavit of support, but it's highly unlikely that a bankruptcy would affect your ability to be the sole sponsor. Consular officers are primarily concerned with income. They are permitted to consider your debts, but...
    1. They would have to find out about the debts (you aren't required to disclose them), and...
    2. The debts would have to impose a severe enough burden that they would affect your ability to maintain the sponsored immigrant at the required 125% of the poverty guidelines.
    For most people, a chapter 7 bankruptcy leaves them with less property and a credit rating in the toilet, but not less income. Unless it get's converted to a chapter 13, it probably won't leave you with any heavy payments. The consulate doesn't care about your credit rating. They only care if you'll have enough money to support the immigrant. As long as you can document that income then you should be fine.
