    Either they don't want to because they are afraid there is no more time to get off in an emergency or the company forces them
    to take it in fragments. Or it's the low pay and they can't afford to take a longer vacation.
    For the real dedicated and self appointed indispensable, it's a wonder that some don't donate part of their pay checks back to the company they work for in addition to not taking all their well earned vacation days. You know, company loyalty and all that.
    First thing, when someone says something about another person is : He/She is a hard worker (as in they must be such a good person)
    instead of he/she is kindhearted, generous, intelligent, creative.....nope it's always a hard worker. I am all for work ethics but puleeaase
    I have a life outside of work.

    And therein lies the other crux. A lot of people in the US seems to frown upon actually taking vacation time. It is a cultural thing, I believe - different from the rest of the world - or Europe at least.

    Almaviva, your best bet, is to forget about going in May .... go in July instead. then you can come back, but won't be allowed to return until you file an I-130. If you go in May, you won't be allowed back in the country for the wedding.

    Marrying someone you don't love or want to be with romantically so they can get a green card is immigration fraud.
    What the OP did was marry some they did love and wanted to be with romantically so they could get a green card and be together. That's what "married to get a green card" means here. That's not immigration fraud, calm down.
    OP, divorcing makes no difference now. Don't worry about the effects of that on his immigration case.

    Be happy you're not on the hook for the I-864 anymore.
    Move on with your life. ASAP.

    Unless you can prove that he forged your signature, which is fraud, there likely isn't much you can do against him.

    My son passed the interview just fine yesterday -- gave him paperwork saying he was approved and an envelope for passport application. They said he will be advised as to the date for Naturalization ceremony.

    Should add that he did carry in a big folder with the last 12 months of bank and credit card info, University ID and enrolment verification, but was asked for none of it. The interview started 50 minutes after appointment time. The interview was an hour long (which worried my husband and I that were sitting in waiting area) My son said it was a relaxed and informal interview but a lot of time was spent "visiting".
    He said he started with the test questions and they were: how many voting members in house; who is father of country; name of current Chief Justice of Supreme Court; name a war in 1900's....and my son can't remember the last question.

    My interview is on March 8th...if all goes well I will be having the biggest burn party with all of my immigration paperwork..teehee

    There's so many uneducated and unemployed people, good that he is motivated to work and study. Just divorce and keep things civil for your child. Its his child too. A working father who's studying is a good role model for any child, even if your marriage didn't work out.

    We used a lawyer through the whole process. The only part I did myself is ROC. Its a very personal choice. Hiring a Lawyer took a heck of a lot off stress of my shoulders (Im a chronic anxiety sufferer)... BUT.... Its an expensive route to take. That said, my lawyer was bloody awesome. I could shoot off an email to him at midnight and he would reply 2 minutes later. At the beginning of the process I was not aware of Visa Journey though and I know many people here have gone through the process filing everything themselves, no problem. Its all personal choice. I wouldn't change our decision to use a Lawyer but you could most certainly do the whole process yourself.

    I am going to get a lot of flack for my opinion.
    I know most people on here are against lawyers, but I am the opposite. Having a lawyer was wonderful. I have browsed these forums through my whole journey and have seen a lot of incorrect information provided by people who pretend to be experts on immigration because they have read about it or have gone through the process themselves. I have seen some genuinely horrible advice on here. I know lawyers aren't perfect but that is why you do research before choosing one.

    Hi,
    Sorry about your loss.
    There is no special dispensation. Especially when you overstay your visa by over a year.
    If you leave with AP or a green card, you will end up with a 10 years ban for overstaying on your K-1 visa for over a year. Your spouse will need to file an I-130 to start the spousal visa process. Your visa application will be denied because of your overstay. Your spouse will need to file a waiver and show why denying you a visa is a hardship to him (missing each other is not enough).
    Sorry, but you didn't make it easy on yourself when you overstayed your visa without filing to adjust status.

    I am sure that after what happened on Dec 2nd, immigration is going to get a lot more difficult. You are definitely hearing more about the K1 Visa process in the media after this. The thing I don't like is that we all know what the process is and how difficult it can be, yet media bring their "immigration lawyers" on there to talk about it and the funny thing is - I know more about the K1 Visa process (thanks to Visa Journey and our own journey thru it) than the lawyer they interviewed.

    It is a shame that possibly one bad person can make the process more difficult for real, honest and true loving relationships. I know we must be vigilant, but shaming the K1 Visa process just rubs me the wrong way. Just my opinion

    I agree with cancel the AOS NOW!. As in stop reading this and write the letter withdrawing the I-864 right now. Mail it today, at the post office, return receipt or at least tracking. Make an infopass appointment and submit the same notarized letter there. Are you still reading and not doing.......do now finish reading later.
    She is milking you for all you have and when you have nothing left she will be gone. Really you paid for her apartment in another country, you are paying her credit card bills for her. She is taking you for a ride and laughing the whole way.

    If she doesn't show her friends on FB that she is married, and crops you out of photos (actively makes an effort to conceal your existence) then I would give her the boot. Put her, and the iPhone, and whatever else it takes to get her moving, and put it all on a plane back to DR. It will be cheaper and less painful in the long run...

    In the case of a name mismatch, always book the flight in the name used on your passport and bring a copy of your marriage certificate showing your married name, to explain the discrepancy.

    Re-scheduling like that can happen, nothing to do with corruption- maybe they overscheduled, or they have someone out sick.
    However, it could also be someone unrelated to the embassy is trying to play a trick on him, so definitely confirm, or try to go anyways.

    Ok.
    The visitor visa was denied because you were deported. The presumption was that you were going to use the visitor visa to come to the US to live illegally again with your family. This is the reason you were denied. Had nothing to do with a fake ID.
    With 11 months in the US after age 18, you were subject to a 3 years ban. That ban is now over.
    If you had lived here for over a year illegally after age 18, you would have a 10 years ban that ends in 2019.
    You were deported from the US, it's either a 5 years ban or 10 years ban. A 5 years ban would be over. A 10 years ban will last until 2019.
    If you have a ban, the K-1 will be denied. After the denial, you can file for a waiver and must show why it would be a hardship on the USC if you were not granted a visa.
    You would need to disclose your arrest for the fake ID. However, this is not a reason to deny your K1.

    Here's what can happen: she gets close to the 90 days from her conditional GC expiring and will ask you to sign the ROC form. You say no. She gets an immigration lawyer that tells her she needs to divorce you. She divorces you. She gets the waiver. You cannot do anything to stop her. Stop thinking of ways to get her. Even if she is not an LPR, but a foreign citizen, she is still allowed to appear in court for the divorce if she so chooses and make your life a living hell... USC or not, LPR or not.

    Not being holier than thou but why should your divorce and spousal obligation be any different than if you were divorcing a USC? Life is short. If you're absolutely sure that your marriage is dead and there's no revival then suck it up, cut your losses and move on so you can put this chapter behind you. You don't want to drag this out and prevent you from looking to your future. Wasted years and bitterness is more costly than a few dollars...but yea man it's up to her whether she wants to stay.

    Your post really makes me cringe. Your wife can't just be shipped back to her home country like some cattle, just because YOU want to. It is unfortunate that the marriage has fallen apart, but since you yourself say that there was no fraud involved, she will still be able to remove conditions by herself with a waiver. She what Boiler said.
