Sorry to perceive that you're becoming defensive. In reading your original post (three times, and very carefully), I truthfully believe that the replies have been respectful and have chiefly focused on exactly what you asked. Those by Jim and Vanessa (two highly respected, very sensible VJ members) are especially worth your consideration.
The Philippines is a third-world country, and the consular officers there are exceptionally attuned to anything that smacks of fraud -- or, if that term is too strong, call it "monkeyshines." Having been through what I myself have been through, and having consulted at least a dozen family-immigration lawyers about real and hypothetical situations, I can offer to you the objective advice that it will probably take a few years and certainly require copious, unimpeachable "evidence of bona fide relationship" before you would have a chance that your approved K-1 petition would pass muster at the consular stage. There are simply too many red flags at this stage -- not necessarily of her doing, and certainly not of yours. Objectively also, your financial status as a student would prove to be another hurdle; the Manila embassy is known to focus heavily on the ability to prove financial support in K-1 cases.
I think that everyone here is looking at that big picture, more than questioning anyone's motives. I join them in respecting the objective pickle that you're in.

From what I have read --I think (and correct me if I am wrong ) she is using u guys both . She is playing the field .She may have used the guy to get a visa to come here , then used you as a ticket to get settled and then moved on . I think the whole scheme smells ''fishy'' and quacks like a duck .To my knowledge --her fiancee can get her deported if she changes her mind about marrying him unless she voluntary goes back home within the 90 days . I think she will get a hard time the next time around at her interview (if you file for her ) . Get some good legal advise before becoming another ''sucker''. Good luck .

You have met the requirements to file an I-129F petition. Presuming you handle the paperwork properly, there's no reason the petition would not be approved. I think the situation will be far different at the US Embassy in Manila.
Honestly, based on what you've said so far, I don't think her chances of getting another K1 are very good at this point. If you and her explain the situation with the first K1 truthfully then it will be painfully obvious to the consular officer that she used the first petitioner to better her financial position for herself and her family. The first petitioner's actions would seem to confirm that he found out about her ulterior motive. I wouldn't be at all surprised if the consulate's Fraud Prevention Unit gave him a call and asked about what happened.
The reality of the situation is that she would have followed through and married this guy if he had shown up at the airport, just so she could get a green card and some financial security. This is the precise scenario they suspect when they investigate a relationship for potential fraud. They are almost certainly going to suspect that she's using you as her backup plan.
My recommendation is to give this relationship plenty of time to develop. If you start the immigration process before you've had a chance to collect a massive amount of evidence of a solid relationship then I believe you are almost certain to be denied a visa.

What they were doing for the last five months was working on other people's petitions for a wide variety of different kinds of immigration benefits, most of which were probably filed before yours.
When they say they are working on petitions from a specific date, all that means is that's the date on the last box of petitions that was pulled from the shelf. If your petition was in a box dated before that then an adjudicator probably already has your petition. Does that mean they've already looked at it? No. It just means it's in the box with the other petitions that adjudicator is currently working on. If that adjudicator happens to be loaded down with difficult petitions, or gets distracted to process RFE's sent for previously processed petitions, or gets temporarily assigned to do something more pressing then K1 visa petitions, or takes a scheduled vacation, then your petition is going to wait. When that adjudicator finally gets to working on your petition then it usually doesn't take more than 15 or 20 minutes to adjudicate it, UNLESS there's a problem. Maybe there is a problem with a background check, causing your petition to be placed in a holding bin awaiting results of the background check. Maybe they need to send an RFE for something. Any number of things could cause your petition to be set aside until everything needed to adjudicate it is available.
The point is that the petitions arrive in chronological order, and get scheduled into the system in boxed sets which are roughly in chronological order. Once that box is pulled by an adjudicator then almost anything can happen to slow down processing on your petition, and many other petitions received after yours could end up getting processed first. It never hurts to check and make sure they haven't lost your paperwork. If it goes beyond the stated processing time then you can contact your congressman or senator and see if they can get some status information for you.
Other than that, be patient. You're going to be dealing with these bureaucrats for a few more years.

Because it would be unfair to those who could not afford it. This isn't one of those situations in life where you can throw more money at it to make it better. Everyone pays the same amount, everyone receives the same service.
Not everyone gets to travel much internationally, either. This forum is full of people who haven't seen their loved ones in countless months due to financial restrictions.
People seem to forget that VJ is a very, very small sample size of how many Visas are applied for every month. In the long run, 5-6 months isn't that bad at all.
What I don't understand is the people who read up on the process, decide to go with it, understand that it will take awhile ... and then, once they're in the middle of the process, complain that it's taking a long time.
Write all the angry letters you'd like. Unfortunately it won't get you anywhere.
I don't think there's anyone here who thinks the system is fine and is loving their wait. There are simply people who realize it is what it is and you have to pick and choose your battles. There are some things in life that you simply cannot change, government bullsh*t is one of them. So you can spend your time waiting, hating every second of it and kicking up a storm because things aren't going your way, or you can simply wait and try to make the best of it. Accept what you cannot change and live your life.

Ugh, PLEASE do not try and undermine me simply because you've waited a little bit longer than I have. I've waited for going on five months now, so I get it. Thanks.
Never ONCE have I said you don't have a right to be frustrated, angry, upset, whatever you may feel right now. I simply said, THAT is the process. That is the way things are. Ranting and raving about it will not speed up your case. It will not make anything easier.
In the big picture of life, these few months aren't going to mean much once we reach our goal.

    I don't like it either.
But you know what? I'm grateful for it. Because it's going to let me live my life the way I want to, which is a huge privilege. It is by no means a right. So while the waiting sucks, and I wish it was easier, I'm just thankful that this process even exists.
Things worth having in life rarely just get handed to you. It takes frustration, patience and hard work.
So I don't like it, but there's no way I'd consider sending hate mail to the people who I'm asking to help me.

What a great opportunity to say something unpopular!
According to the latest census, there are currently about 310,828,691 people living in the US. Although the Census doesn't tell you how many of those are of Russian descent (if this is what rocks your boat), it's fair to assume that there are more potentially suitable spouses for you than you can possibly check out in your lifetime.
The US Government does not regulate who you can marry, as long as it's a human being (no space robots, no animals) of the opposite gender. What you asked the US Government (not the State) for is to import yet another foreigner from a country that was the US's largest enemy for a very long time, shortly after a Russian Spy ring was exposed.
It is only reasonable for a government, any government, to secure its country's borders and make sure that no unauthorized aliens can enter it or live with it. The US Government takes this mandate very seriously.

It won't be the same anymore? I think that speaks of deeper issues rather than just unhappiness with USCIS. Yes, it's a garbage process and doesn't work nearly as smoothly as it should for the amount of money we pay for it ... but we're all working towards the same goal and that's to be with our loved ones.
Personally, as soon as I get my Visa in hand, I won't give two craps about USCIS. Yes, I'll still have to deal with them for my AOS but who cares? I'll be home in the US with my love.

If you stayed in the US till the interview... how would you get your medical done and your papers collected and filled out and your police certificates etc etc etc.
The right thing to do would be to file the K-1 and return home after your vacation. Not stay in the US and overstay etc.

Honestly, you lived and worked here illegally for the past 3 years and now you are looking for us to tell you that what you did was ok and will not effect your future immigration petition. I don't think anyone here can do that. I'm sorry we can't give you the answers you want to hear, but I can't imagine anyone on this forum telling you it is ok to lie on your application or withold information, especially since all of us are going through the process legally and have been separated from our significant others for long periods of time waiting for visas. You just have to go through the process however you think is best and hope it works out.

As stated no, it will not work. The K1 visa ONLY allows your to adjust status with the person who petitioned you. You can marry your new bf if you want, but you will be unable to stay and adjust your status. You will have to leave the country and apply for a new visa. If you're married it will be a Cr-1 visa, if you're just engaged it's another K1. Be prepared for this new relationship to undergo a LOT of scrutiny given the circumstances surrounding your meeting.
It looks VERY suspicious that you happen to meet someone else while in the US on a K1 just DAYS after arriving, and then that in the span of 2 weeks of knowing you, you're both in love enough to marry? You also stated he felt "pity for you", that's not love so him offering to adjust your status is immigration fraud (not that it matters here but it's still fraud). Not to mention it's pretty obvious from your post that you went online with the explicit purpose of meeting someone else. It took you 2 weeks to move on from someone you APPARENTLY loved enough to apply for a K1... that alone looks suspicious.
** moved from "Adjustment of Status (Green Card) from Family Based Visas" to Effects of Major Family Changes on Immigration Benefits as this is a more appropriate location**

Actually they did call and inquired many times but were only told to be patient and wait. They did, they never complained openly about it, they dealt with it (he went to visit her again, unplanned) and now they are together and are very real and very happy.
You can read our timeline to see our history. A year ago CSC did the same thing as you are seeing here. No touches until a day before the big approval announcement. You can only be patient. If you don't like the process, then I trust you vote in our elections and only elect candidates the support your views. The alternative is go live in another country or find another spouse. Sorry if this is so cruel but that is the way it is. One needs conviction and backbone and maybe some are not cut out for that.

I don't know if this is true or not since my lawyer has given me a few untruths already, but when i asked him about calling the congressman, he said it COULD go well if he has a lot of pull, but that consequently, it COULD just get pulled, looked at, and then they decide nothing is wrong and is going as it should, and then be put back in line except farther back than it was by a few weeks.
so just in case they actually know what they are talking about, i'm going to just sit and wait my turn like everyone else and not try to line jump (which is kind of rude if you think about it anyways).
