    wow.. what a horribly written article that basically says nothing.. The "probe" is only covering USCIS which is more about documentation than anything else - they make very little "gut" decisions..
    The first half of the article talks about how there is pressure to say "yes" that has gotten worse during the Obama administration.. Then it gives these two paragraphs:
    Nevertheless, USCIS approved 86 percent of the 3.9 million immigration cases it reviewed between October 2008 and October 2009 — a 4 percent drop from the year before, according to the most recent data provided to The Daily.
    And immigration attorneys complained that it seems like officers are just looking for reasons to deny a case, and already demand a higher standard of proof than what is required. That standard is now considered a 51 percent likelihood that a fact is true.
    So... They approve 86 PERCENT which is 4% drop.. This does not sound like stepped up pressure to say "yes" like the first half of the article says and it does not sound like they are just looking to say "no" like the lawyers are claiming.

    i do not understand why people cling with such desperation to the need to preserve marriage for "one woman, one man"? how does someone else's choice of an adult, non-goat, same-sex spouse affect someone who's living in, let's say, alaska?

    Sorry, it isn't a public contract. You and I can bicker about it but it is not a public contract as defined at law.
    Think about it this way -- let's say I agree to buy a building, a garage and some land from Joe Smith. Joe assures me that the land comes with the right of way to access to the garage. As it turns out, the land doesn't have this easement. I sue Joe in civil court. The government in the form of the judiciary gets involved to determine whether or not my private right to enjoy my land has been affected. Whether or not parties choose to settle outside the court, the court is always involved. This doesn't make the contract I had with Joe "public" any more than a marriage contract is somehow public.

    Sama,
    no disrespect, but you don't know what you are talking about. You are lacking the very basics, the 1 x 1 of immigration. Your headline talks about marriage to an illegal immigrant, but your post then shows that he's not an illegal immigrant. It's really quite pointless to talk about illegal immigrants if you don't know what that is. So let's get this out of the way first:
    Out of Status vs. Illegal Immigrant
    Somebody who came legally to the U.S. is NOT, I repeat NOT, an illegal immigrant. Such a person is "out of status." What's the difference?
    1) Out of status
    Somebody who entered the U.S. "with inspection" which means with a visa or as part of the VWP. Such a person applied for a visa at the U.S. consulate in their home country. They had an interview and needed to submit a police certificate. They were issued a visa and then they were inspected again before being "admitted" to the U.S., at which time they received an I-94 (Entry/Exit) form in their passport. The U.S. government knows everything about them; their name, their parents name, their birth day and birth place, their criminal history, work history, and even where they are staying in the U.S.
    2) Illegal immigrant
    Entered the U.S "without inspection" (EWI) by hopping a fence, swimming through the Rio Grande, or hiding in the trunk of a car. The U.S. government knows absolutely nothing about them. Not-a-thing. They could be mass murderers or serial child rapists, drug smugglers or worse.
    The difference is easily illustrated by comparison:
    You are having a party. You invited a guy to that party and when the party is over he's still staying. All you need to tell him is to leave, and if he does, you have no problem. That's the guy who overstayed.
    But if you don't have a party, come home, and there's a guy who climbed into your house through the back window, and you have no clue if he's just a thief or worse, that's the illegal immigrant. Here you need to call the cops and they have every right to arrest him for a crime: breaking and entering.
    Now to your question.
    Since the gentleman is NOT an illegal immigrant, he is eligible for Adjustment of Status (which would be impossible if he were an illegal immigrant). They submit I-130, I-485, I-864, 2 x G-325a, and I-765 (optional) concurrently to the USCIS, accompanied by a medical and a check for $1,490. That's it.
    If he leaves the U.S. before he got his Green Card, he won't be coming back for 10 years+.

    Danno logic strikes again. Okay, Mr. Logical Genius - so if it were popular to ban racially mixed marriages, you'd support that, right? Being that you are so "pro-democratic?" For those who are civics challenged, it might behoove them to actually go back to school and understand how our democracy works in this country as opposed to mob rule.

    You misunderstand what a 10-year visa is. That means it is valid for 10 years for trips... coming and going. Each stay can be a maximum of 6 months. It is not a visa to live in the US for 10 years.
    He was here for 5 years 2000-2005 illegally which means he has a 10-year ban. I am unsure how he was allowed back in to the country in 2005 - he should have been denied at the border. That makes me wonder if he entered illegally - jumped a fence.
    Illegal work can be forgiven for spouses of US Citizens, but if he stole a SSNumber of made one up or claimed to be a USC, that is not forgiven.
    He was already married. I wonder if the wife refused to file for a GC and that is why he left her.
    You have already been scammed for one greencard. Are you sure this isn't another? There are a lot of red flags.
    If you're sure it's legit, then you will have added scrutiny. Also, if he jumped a fence this last time (because he should have been denied at the border for overstaying) then he cannot adjust status period.

    Mr. O. is not my favorite Prez either. I so wish he had less corporate ties, bigger balls, and didn't always try to play with the Reptilians. But he is still a million, billion, trillion, gazillion times better than the best Reptilian candidate right now.
    So what has Obama actually done in the past 3 years?
    One of the most irritating things I hear these days is the idea that President Obama is really no different than Bush, or that he's a "disappointment." Both of those characterizations are flat ignorant. If you truly believe that, you're in serious denial, and you can't be paying very close attention. In fairness, perhaps you were in a coma for the eight Bush Years, and if so, I forgive you. But please join the real world. So far, this president has done most of what he said he would do if elected, and he's not even through his first term. Imagine what he could have done by now if we supported him, and gave him a Congress that doesn't look at him as if he's the demon seed.
    Not only is he NOT a "failure," he's pretty much the opposite. And no, I don't just say that because he took out Osama bin Laden and helped Libya determine their own destiny for the first time in a while.
    Is he perfect? No, he's human. Does he deserve some criticism? Sure. But criticism about certain specific problems is one thing; taking on an overall "Obama sucks" meme not only has the potential to put another Bush into power, but it's also a lie. Just because you wanted a president who would give you a unicorn that farts the Star Spangled Banner, doesn't mean he's not doing well at the job we hired him for.
    What follows is a PARTIAL list of Obama's accomplishments so far. Unlike many such lists, there is a link to a citation supporting every single one.
    Anytime someone, right OR left, tells you Obama sucks, or is a "disappointment," show them this list and tell them to kiss a part of your body not usually considered pleasant to kiss.

    First the bad news: nope, an I-140 won't work for you. Even if you were to fall under the category of a "skilled worker," there are plenty of people in the United States who can do what you can do. Not a chance. None.

    The good news is that you arrived in the U.S. with a visa. You were inspected at the airport and received an I-94 form stapled into your passport. Your passport itself was stamped as well, so you have proof when and how you arrived in the United States.
    As such, you are eligible for Adjustment of Status when the time comes. When does the time come? When you meet a nice man and are ready to get married, as long as this nice man is a U.S. citizen, of course. In addition, I am certain that the DREAM Act will pass Congress in one form or another in late 2013 or early 2014, and when that happens, you will be aboard the ship that will carry you to Green Card land.
    Until then, stay out of trouble.

As a Jesus lover, do you seriously consider Jesus as a sinner because he consorted with so many of them? Similarly, I do not have to be an animal lover to defend an animal being abused. Or have a Black boyfriend to speak out against racism.
    However, it is unnatural and sick to obsess about what someone else does behind close doors in the privacy of their own home. If you dont like homosexuality, then don't bang a guy, or think of a guy banging another guy, and move on with your life. There are plenty of other important things like starving kids, disease, famine, rising healthcare costs and world peace to worry about.

    Marrying pets really?... I figured that would come up when mentioning gay marriage. Same way 50 years ago, people thought interracial marriages were sick and repulsive and it wasn't till the mid 90's that interracial marriages was above the 50 percent approval rating in our nation.     there are folks on vj who are gay - this isn't some weird straights only club of people that might just be friends with someone. granted family immigration laws discriminate against same sex couples, but that just means that they are often even more likely to be searching for ways to be with their spouse and end up stumbling upon vj.

    HPV is insanely common and says nothing bad about you as a person. I would absolutely check yes on the form - they probably wouldn't find out, but it's best to just never lie when so much is at stake. Especially since it's a lie for no reason other than the fact that you seem to be a little ashamed of it. I am a healthcare provider and I can tell you that this is something seen every day with every type of person. Work on getting over your shame about this and don't let such an inconsequential matter cause you so much distress when it doesn't need to. It won't have any impact on your application whatsoever.
