You can also thank all the people who AOS from tourist visas for the difficulty getting your MIL one. They aren't just worried about people staying in the US illegally but also people who may change their mind and pursue a legal way to stay once they land. Good luck.

The taxes that you paid are for people who are here legally to attend school, either US citizens or people with the proper visas. I started working when I was 14 and have paid taxes for 36 years and never had any kids go through the school system. That does not entitle me to do something illegal just because I think I paid for it.
I find it hard to believe that your stepson is in private school but you can't afford health insurance or an attorney. It may be true, but it doesn't make much sense.

Nonimmigrant visa holders are responsible for knowing the restrictions on their visas.
For example, visitor visa holders are responsible to know they can not work in the US.
The law does not permit non immigrants to receive regular Medical.
It's not considered "unintentional" when your wife goes and apply for Medical. She knew she was applying for and using Medical.
Ignorance of the law is not an excuse.

There is no right to immigration. Even with a visa or a GC, there is no right to enter the US. The only people guaranteed entry to the US are US Citizens.
The OP has no spouse to go live with, and she wants to use a spousal visa. Anyone encouraging her is encouraging illegal activity and fraud.

Here we go again. Members providing legal advice based in hearsay and anecdotal stories of something they have no experience with.
Personally I think she's using you people to provide circumstantial evidence of an ongoing abuse to stay legally.

1. She has a visa to come to the US for the purpose of being with her spouse. That is no longer her intention thus the visa is not being used for the purpose it was issued. Same if you come on a tourist visa and conduct business, that is not what the visa is for.
2. No one should ever lie to immigration. That could result in an immediate life-time ban from coming to the US. Even if she made it into the US she could be later found out and deported.
3. She doesn't have to sign anything for the divorce to be processed.
4. He could very well have already informed immigration that they are no longer together and she could be turned around at the airport since her visa is no longer valid (no spouse, no valid spousal visa).
5. Her visa is not for the purpose of her coming to the US to divorce. That can be done without her or with her in her country.

The purpose of the visa is for you to be with your husband. He can contact immigration and inform them you are no longer together and your visa will no longer be valid. If he sends proof that he has filed for divorce it will also make the visa invalid. Whether he has done this or not is unknown since you are no longer speaking to each other.
Trying to enter with a spousal visa when you are no longer with your spouse would be fraud. Also it is possible you will be turned around when you attempt to enter the US and returned on the next flight.

So basically, you have no interest in being with this guy (understandable, since he is obviously insane), but you want to go to the U.S. anyway? Sounds like you married him for a greencard, which is immigration fraud.
BTW, he doesn't need a lawyer to divorce you, he can do it by himself, and doing so does not require your permission.

Mind changing (note, moments after baggage claim, which seems to be a constant) only makes it harder for others in the future to get b2 visas...you and your fiancee wanted the vo to believe and trust you....now what? Recently, I found out that one of my employees did the same thing....lied to get a tourist visa for her foreign fiancee...they married 2 days after he arrived...I fired her two days later. I don't have much patience (none) for those who cheat our system and fully expect to be rewarded for doing so (she foolishly invited me to the wedding, where the story came out...she and her new husband were actually laughing about how 'dumb' the VO and our border officials were....the laughter stopped on Monday, when she showed up at the office, with her stuff from her desk all boxed up...I even asked somebody to put a nice bow on the box.
Bottom line: a B2 visa is supposed to be an object of trust, given to the trustworthy. When that trust is violated, it ruins the opportunities for others.
