    The CBP officer can make notes under your I-94 number that can be accessed during your AOS interview. If you came into the country and were questioned by the CBP officer and then during your AOS interview they do not parallel then you have just committed material misrepresentation.
    For example:
    CBP: what is your purpose in the US during your stay?
    you: to visit Disney World and feed the dolphins!
    CBP: do you have any family or a boyfriend in the US?
    you: No, I just want to feed the dolphins!!
    CBP: okay... (type, type, type)
    6-months later...(version 1)
    IO: how did you two meet?
    you: we met while I was feeding dolphins!
    IO: okay, odd..I mean interesting! (type, stamp, approved)
    6-months later...(version 2)
    IO: how did you two meet?
    you: we met online, he came to my country and we got engaged and talked about feeding dolphins!
    IO: OH, r..e..a..l..l..y...... (evil internal laugh)

    Oh, one more point that I would make in regards to your fiancee taking courses here. If she is planning on taking courses as supplement or getting a new degree, then she could indicate that she is a new student. Don't mention the degree that she earned in China and apply using only her high school level. Most schools won't ask for her grades translation and will simply have her take placement testing. Also to consider is that most Universities will require a TOEFL score for admission; community colleges usually have their own English assessment testing. On the face, someone might think I am suggesting some kind of fraud by telling you to ignore the Chinese university degree, which it is not unless she tries to obtain financial aid. This is just one idea to make the transition easier, you will still be paying for classes.

    I am a father in my 30s so I can not answer the age related questions, other than to tell you that you will be sleep deprived as newborns eat about every 2 hours (24-7) for the first couple months.
    You have the cultural considerations regarding the pregnancy. There are many superstitions that some Chinese woman follow that could really have your head swimming. Depending on her family and education, she may strictly follow some of these thoughts. Find out about this now.
    Why have you already decided you need to have in-vitro? Have you had a sperm count performed and found the number is low? If not, you might be just fine to go the natural route.
    "I have frozen my sperm but someone told me that genetically damaged sperm swim faster than the good ones. Any experience in doing genetic testing?" Who told you this??? A doctor? You need to speak with your wife's OB/gyn and he/she will tell you about testing that is available for the baby in-utero and can also give advice regarding what steps you should take preconception (e.g. have her on prenatal vitamins for a few months beforehand).
    As a species, we have been having children for thousands of years, so don't sweat it too much. If you want a child, then have a child and enjoy the blessing. My only real concern would be to think about the future. Your age puts you at greater risk that this child may not have a father as his/her college graduation, BUT that could also happen to any of us regardless of age. Plan for the future, is my point.     It is a huge factor, and in China it is NORMAL for an older man to marry a younger woman for multiple reasons. This is what happened in your case, an older male, so the VO doesn't see this as a "visa killer" and gave the K1. The OP is in the opposite position, a culturally opposite situation. There have been too many cases of men from the beneficiaries region of the world who have married older women to gain an entry into the US and then disappear. If you don't believe this, read back over the last few years of VJ archives and you will find many stories of just this case. The consulate knows this and that is why they heavily scrutinize. The OP will probably have to go and marry and spend time and establish a stronger relationship in the eyes of the consulate. Good luck!

    hey dude, sorry about the white slip, but am I wrong or are you miss quoting above? You indicate just receiving a white slip for a K1, but also just stated a finalized divorce in July 2010?? If this is true, then the fact that you were not "legally free to marry" is the reason for your white. Please correct me if I am wrong in your wording. Good luck!

    Okay, I think the OP can see from the he is getting from everyone that he is certainly afoul of standard procedures and possibly has some financial issues and heads-in-the-clouds relationship issues, but that is not the point of the post. Outside of getting offline once in a while and not watching his fiancee sleep and get a second or a third job to be the future husband he wants to be, he is going to have nothing but an uphill battle. As for some "scam" claims others have raised, sure it is possible but we shouldn't speculate too harshly since he hasn't posted much to give any clues to that. To do so otherwise would just label all filipino girls as scammers and that is a slippery slope. Make sense, dude?

    Me 33, Yi 31.
    On this forum, it is quite common to see larger age difference from some countries, and in certain countries this doesn't matter. The only time this makes a big difference is for countries where the societal or religious norm is for a certain perspective. Two examples, a 39 year old American won't be too scrutinized with a 19 year old Philipino gal. However, a 25 year old Egytian male has nothing but an uphill fight to get approved with a 35year old American woman, this due to societal norms. Doesn't mean the relationship isn't legit. Great topic!

    I don't know all of your circumstances, but you are giving up your relationship because of this obstacle?? Maybe you can take time to relax and refocus and then you will feel better and approach this problem with a strong solution. However, if this causes you to give up so easily, perhaps this is fate and you would only find harder times in the future here. I hope you find what you want, but always know that VJ is here to help and support.

Maybe you can take time to relax and refocus and then you will feel better and approach this problem with a strong solution. However, if this causes you to give up so easily, perhaps this is fate and you would only find harder times in the future here.     I think that there have been enough responses on this and I think that you can see that everyone is supportive but also strongly leaning towards a consensus that there is an issue with her reasoning for delay. There are probably many factors at play that are causing her to react this way and only the two of you can resolve this. However, unless every other facet of this women is perfect, then I would seriously question a person who places so much value on the cost and glamor of an event over the possibility of being together at an earlier time. I also feel that a couple in which one partner focuses on the financial benefit of the relationship rather than the other person will ultimately face many hardships and often failure over time. Consider these issues and move forward rationally and with conviction to prevent future heartache, my friend.

    Is she a student on her own funding or is she supported by the Chinese government? If the latter, then she may be subject to a home stay and not eligible to adjust status until the home stay is complete. Just have her check on that to make sure you are in the clear. Good luck!

    All of the posters on here who keep saying to go to Brazil to get married should use caution in their use of this forum because they are new members who seem to lack any knowledge of the immigration process. If you are both legally able to marry, the location and time doesn't matter, only the action taken to apply for immigration benefits. Any part of the process that require loved ones to be separated is painful, however, emotional responses without fact-based foundation WILL only bring our members more mental anguish or possible troubles. Please refrain from these types of comments just so that you can have a comment.

    Just like a prior marriage, GUZ will use that as bait for the fiancee to see how aware she is of the previous relationship and try to trip up the applicant. Not always, but most guys on here who have gone through GUZ with a previous marriage will tell you this was definitely part of the questioning process. So, your girl is going to need to have full disclosure on the previous K-1.

Did he say some stupid, unqualified things...yes; however, I am sure that given the kick to the jewels he has just experienced they were purely uncontrolled emotion. The point of our forum is to guide and keep on point. If everyone who reads through this thread just piles one more negative, unhelpful comment onto this poor guy then there will be no real value added and the thread should just be closed.     Now to the issue....
    I suspect that a lack of front loading combined with only one visit is the primary reason for the white slip. It seems GUZ has a track record of dinging people with only one visit unless you are also at the interview. This one visit might also have not allowed for enough pictorial documentation with family that GUZ also likes to see these days. The VO does review the file and is able to draw and instinct decision about the couple. That is why many times we see "pinks" handed out with only a couple of pedestrian questions, the VO has already seen enough from the initial filing to know the bona-fida is met. The converse is also true, a scant file gives immediate suspicion. The embassy is not charged with handing out visas, rather they are gatekeepers and will bounce anything that isn't rock solid (this is my personal view based on over a year of following MANY members through GUZ). Without seeing the OP's full petition there is no way to know what could have given the VO suspicion but something raised an eyebrow.
